Understanding Property Consent Orders

A property consent order is a written financial agreement between former partners, approved by the Federal Circuit and Family Court of Australia and made into a court order. Once approved, it carries the same legal weight as any other court order. Before approving it, the court must be satisfied the proposed division is just and equitable, based on factors set out in the Family Law Act.

Both parties must give full and frank disclosure of their assets and liabilities as part of the process. Consent orders can generally only be changed or set aside in limited circumstances, such as fraud or non-disclosure.

Divorce Hearings Are Moving to Webex

From 31 August 2026, most divorce hearings that need you to attend before a Deputy Registrar are held using Webex, a video platform, instead of by telephone only. The link is usually published on the Commonwealth Courts Portal and the daily court list the day before your hearing.

You can join from a computer, smartphone or other suitable device, and video is generally expected unless you have a reason you cannot appear that way. This is a change to how hearings are run. It does not change the legal requirements for getting a divorce.

If you have a divorce hearing coming up, it is worth checking the current process and speaking with a family lawyer about what to expect.

Jomandie van der Merwe, Senior Solicitor, has practised in family law since 2014, working across property settlements, parenting matters, financial agreements, and contested hearings. Her background in broader litigation shapes how she works: practical under pressure, and honest with clients about what a situation actually needs, not just what feels easiest to hear. Jomandie is admitted across three Australian jurisdictions and is currently completing further study in family law.

Outside the office, she is usually found on a Sunshine Coast beach walk, at brunch, or with the family dog.

You don't have to get it perfect, just steady

If you are working out parenting arrangements right now, you are not alone in finding it hard. Many parents feel the same pull between wanting to protect their children and not knowing quite how to start.

A few general things can help. Try to centre arrangements around your children's routine, their school, and their time with each parent. Keep communication with the other parent clear and respectful where you can, and keep any tension between adults away from the kids. It is okay for the plan to change as your children grow.

Where it is safe to do so, family dispute resolution can help two parents find common ground. Under family law, everything comes back to the best interests of the child.

Reaching an agreement with a former partner, on your own terms, can feel like real progress after a hard stretch.

Consent orders are how you turn that agreement into something the court will formally recognise, whether it covers your children's arrangements or how property is divided. For parenting matters, the court looks at what is in the best interests of the child. For property, it considers whether the split is just and equitable. They can be difficult to change once made, so it is worth understanding what you are agreeing to before you apply.
