In a recent decision from the Federal Court of Australia, an employee who suffered from autism failed to notify his employer of his medical condition prior to commencing employment.

During the probation period the employee's employment was terminated on the grounds of unacceptable behaviour. The employee sought to bring an action against the employer for disability discrimination. However, as the employer was unaware of the employees' autism, which was the primary reason for the behaviour, the court ruled in favour of the employer.

The onus is on the employee to provide full disclosure of conditions that could affect the ability of the employee to safely carry out their duties.

ACTION BY THE FAIR WORK OMBUDSMAN AGAINST FRANCHISOR

The Fair Work Ombudsman has commenced proceedings against a franchisor in the Federal Court with allegations including the underpayment of nine workers who were employed by the franchisees, relating to workers being paid under their minimum rate of pay, overtime, penalty rates, casual loadings, laundry allowance and annual leave entitlements.

This is the first time the FWO has claimed that a franchisor, although not the direct employer of the workers, is responsible for the actions of the franchisees as they ‘knew or could reasonably be expected to have known that the underpayments were likely to occur.’

Businesses have been warned to increase their cyber-security measures after the Federal Court ruled that a business had contravened the Corporations Act, by failing to have an adequate risk management in relation to data security breaches.

The business was required to pay $750,000 in legal costs, after being targeted by several attacks in which hackers sent fraudulent emails to clients, obtained the personal information of over 200 clients, and even deceived a client to transfer $50,000. The business was found to be at fault because its cyber-security systems and compliance procedures provided inadequate protection.

As of yesterday, the 20th of February 2023, e-conveyancing has been mandated and is compulsory for all conveyancing in Queensland. This means buyers and sellers no longer have the choice to opt for a paper settlement.

A critical aspect of e-conveyances for lawyers and their clients is to ensure their clients have provided sufficient original identification to satisfy the verification of identity requirements. A lawyer is unable to transact electronically on their client’s behalf if their client has failed to produce sufficient forms of identification.

For the identification to meet the strict verification requirements, the identification must be current, and the spelling of the party names must be uniform across all forms of identification.
