Public Service Announcement: not every lawyer you meet is out to rinse you 😱 shock horror. Sure, we have a business to run, a job to do, a HEFTY HECS/HELP debt to pay, but we also have goals, an ethos and a moral compass 🧭 .

We catch ourselves a few times a week saying phrases like “I don’t want to put myself out of a job, but…”. “What is this really worth to you?” And “Do you understand your legal costs will likely outweigh what you might gain”. 💡

We don’t create the system but we work it. We know it and we know that you need to make practical, pragmatic and commercial decisions in the most emotive time of your life to come out on top. 💰

Form 11 Application for Consent Orders is used to formalise agreements between you post separation ✅

Usually it has taken you some time to come to an agreement, if you haven’t, then we can’t complete it until we have negotiated an agreed outcome for you 🤝

You can help prepare for the Form 11 by:

Exchanging all relevant financial disclosure 📄

Determining the current value 💰 of all assets and all liabilities 💸

Putting the Form into “draft” with ALL the relevant personal and financial details. https://www.familycourt.wa.gov.au/A/application_consent_orders.aspx

Once we have the above, the document can be prepared. But it doesn’t just include the Application Form, it requires a Minute of Consent orders for the court to pronounce orders effecting the agreement, sometimes superannuation bodies need notice and if you were in a de facto relationship there is an additional Affidavit. 🗂️

If it’s not becoming clear, this process takes time 💡

There are only very limited circumstances where we can facilitate urgently drafting a Form 11🚨. And for everyone else your reasonable expectation from start to finish should be 4-8 weeks for the process with a pre-exisiting agreement, and longer without.

We understand once you separate you want to be able to move on, you crave clarity and an end to the stress of the unknown but we don’t rush such an important process. And practically speaking, we have law degrees, not magic wands 🪄.

As they say, good things come to those who wait. Form 11’s come in a couple of months 😅 well that’s what we say anyway.

Was great to network with Community Legal Services recently and discuss some of the challenges the community legal sector is facing ⛈️

PCLS provide invaluable support and assistance to some of our communities most vulnerable people. This week Ferguson Family Law underwent its first trust audit and everything went off without a hitch… I can tell you for sure it’s not because I can do everything 🤯.

While I was tail spinning, worrying that I might not be cut out for all the things legal practice director requires, these two amazing humans quietly and quickly got the job done. Files checked, end of months already collated, forms completed and gentle nudges of encouragement distributed 😭🤗

How lucky am I to have this amazing team and how lucky are our clients to be greeted by Michelle, who’s always got time for understandably anxious phone calls and a little bit of disorganised disclosure 😅. And Hollie who diligently keeps everyone informed of where they are at, makes sure there are no fee surprises and reminds me regularly that organisation really does pay off.
