We wanted to share an important update about new compliance requirements that will only apply to property transactions in Australia from 1 July 2026.
From this date, new Anti-Money Laundering and Counter-Terrorism Financing laws will apply to real estate agencies, buyer’s agents, settlement agents and other property professionals. As part of these changes, Kevin Green Real Estate will be required to complete identity verification and due diligence checks for clients involved in buying, selling or transacting property.
This update is being sent to all clients for your information. The new requirements will only apply when you are involved in a property transaction, such as selling, buying or entering into a relevant property matter with us.
While this is a new legal requirement, our approach will remain the same: clear, discreet and as streamlined as possible.
What this means for you
Before we can proceed with a relevant property transaction, we may need to verify details about you, your purchasing or selling entity and, in some cases, the source of funds or ownership structure connected to the transaction.
These requirements will apply even if you are a long-standing Kevin Green Real Estate client, or if we have acted for you before. Under the new legislation, we are still required to complete the necessary checks at the time they are required.
What we may ask for
Individuals
A government-issued photo ID, such as a passport or driver’s licence.
Companies
Director identification and details of beneficial ownership.
Trusts and SMSFs
Trust deed, trustee identification and relevant ATO, ASIC or supporting documentation.
Source of funds or source of wealth
In some circumstances, information about the origin of funds being used for a purchase or transaction.
We know this is another admin step
We understand this may feel like an added inconvenience, particularly when you are ready to buy, sell or move forward with a property matter.
Please be assured that we will make the process as simple, secure and efficient as possible. We will guide you through the compliance process at the relevant time and explain what is required based on your individual circumstances and transaction structure.
We will only ask for the information necessary to meet the new legal requirements.
Your privacy is protected
Kevin Green Real Estate will be using First AML, a specialist compliance platform, to collect and verify the required information securely.
Your documents and identity information will be submitted directly through First AML’s secure platform, rather than being emailed to Kevin Green Real Estate or stored on our internal servers.
Your information will be handled confidentially and will not be used for any unrelated purpose.
