Experiencing a relationship breakdown and navigating the legal system? Changes are coming that may impact your division of property and finances.

Currently, separating couples can make their own arrangements regarding what happens to their finances and property when a relationship ends. If you’re unable to reach an agreement, you can apply to the Federal Circuit and Family Court of Australia (FCFCOA) to determine a property settlement.

From 10 June, 2025, significant changes to Australia's family law system will come into effect. These changes aim to enhance fairness, clarity, and responsiveness in the division of property and financial matters, and will apply to all separating couples, whether their property settlement is determined by the FCFCOA or they are negotiating outside of the court system.

In our latest article, Family Law expert Katrina Beltran outlines what the reforms could mean for you: https://www.cdq.com.au/family-law-property-settlements-june-2025-reforms

It’s important for everyone to have a valid will. Anyone who passes without one, is said to have died “intestate.”

Understanding what happens under intestacy laws is crucial for anyone who wants to avoid unintended outcomes for their loved ones. It can create uncertainty and complexity in how your estate will be distributed, as well as potential issues for loved ones left behind.

In NSW, the distribution of a deceased person's intestate estate is governed by the Succession Act 2006 and will depend on the particular circumstances of the deceased.

In this article, Emily Hancock, Junior Solicitor, provides an overview of the legal process and potential implications when someone in NSW dies intestate: https://www.cdq.com.au/dying-intestate-what-happens-if-you-die-without-a-will

If you don’t have a valid will, now is a good time to get your affairs in order. Whilst it might seem like an unpleasant topic, a little time spent planning now could make a lot of difference for your loved ones in the future.

Speak to one of the experienced lawyers at Colin Daley Quinn on 02 8556 0130 or [email protected] and find out how simple the process can be.

Choosing an executor for your Will is an important step in the estate planning process.

An executor is responsible for managing your estate after your passing, ensuring that your assets are distributed according to your wishes, and addressing any legal and financial issues that may arise.

It can be a difficult task, particularly when dealing with a complex estate, large asset pool or multiple beneficiaries, which makes it even more important to choose the right person and to ensure that they have the support they need from a legal adviser.

In this article, Director and Accredited Specialist in Wills & Estates Law, Nicolas Moore, looks at the important issue of choosing an executor for your Will, why you need to give careful thought to the appointment, and the things you should consider when making your decision.
