WA's stamp duty rules just changed. Most first home buyers haven't run the new numbers yet.

From 7 May 2026, the WA stamp duty exemption now covers first homes up to $600,000, up from $500,000. Here's the part worth knowing: the saving amount depends on what you buy. Buy an established or new home under $600,000 and you save up to $22,515 in stamp duty. Buy vacant land and build, and that saving rises to $25,390. If you're weighing up both options, the gap is worth factoring in.

Stack that with the $10,000 First Home Owner Grant and the Federal First Home Guarantee, and the cost of getting into your first home in Perth looks very different to what it did six months ago.

We get it. It is 80 pages of legal language written by the builder's lawyers. Nobody warns you what to look for. And by the time you find out what you missed, you have already signed.

The building contract most Perth buyers sign is not as protective as they think.

Here are three things I see buyers get wrong and what WA law actually says.

***Rise-and-fall clauses.**
Builders sometimes include clauses that allow them to pass on increases in material or labour costs to the buyer. These clauses are prohibited under the Home Building Contracts Act 1991 (WA) and void if included. If your contract has one, it cannot be enforced.

***No cooling-off period.**
WA has no statutory cooling-off period for residential building contracts. Buyers in NSW get five business days. Victoria gets three. In WA, the moment you sign, the contract is binding. There is no grace period to change your mind.

***The 6.5% deposit cap.**
Under WA law, a builder cannot take more than 6.5% of the total contract price as a deposit before work commences. If you are being asked for more upfront, that is worth questioning.

These are not obscure technicalities. They are the clauses that generate the most disputes and the most preventable losses.
