When you’re making significant changes to your Will, particularly later in life, there are a few important things your lawyer needs to consider.

⚖️ Testamentary capacity – Do you understand the nature and effect of the Will you’re making?

⚖️ Undue influence – Are these genuinely your wishes, or is someone else influencing your decisions?

⚖️ Potential estate claims – Just because you leave someone out of your Will doesn’t necessarily mean they won’t be able to make a claim against your estate.

A properly prepared Will isn’t just about recording your wishes. It’s about making sure those wishes are understood, properly documented and given the best possible chance of being upheld.

And sometimes, the conversations we have when preparing your Will are just as important as the document itself.

Your divorce doesn’t become final until one month and one day after your divorce hearing.

That means your divorce generally needs to be granted by 30 November 2026 to be finalised before the new year.

And with November hearing dates filling up, now is the time to act!

If finalising your divorce is still on your 2026 to-do list, don’t leave it until December.
