If a work-related injury has caused permanent impairment, you may be entitled to lump-sum compensation.

Your impairment must be assessed as a percentage of the whole person by an appropriately accredited medical practitioner. Minimum impairment thresholds apply, and the rules are different for physical and psychological injuries.

The timing and consequences of a permanent impairment claim can be important.

It depends on the type of hearing and the issues involved.

For an initial s81A hearing, some workers appear without a private lawyer or obtain assistance from Worker Assist Tasmania.

Other Tribunal proceedings, including substantive disputes on entitlements, can be more complex and would benefit with legal representation. We can advise when it is the right time to speak to a lawyer.

If you receive documents from TASCAT, get advice promptly. We can explain what the documents mean, identify any deadlines and legal referrals.

Overtime or excess hours may be included when calculating your normal weekly earnings—but only if all four legal requirements are met:

1. The overtime or excess hours were required by your employment contract.
2. You worked them in a regular and established pattern and according to a roster.
3. The number of hours was substantially uniform.
4. You would have continued working those hours if you had not become incapacitated.

Payslips, rosters, timesheets and your employment terms may help establish the pattern.

This does not necessarily mean your claim is over.

At an s81A hearing, TASCAT decides whether the employer has a reasonably arguable case for disputing liability.

It effectively puts your claim and the payment of compensation on hold.
You may be able to pursue your claim through a substantive referral to TASCAT, including a referral under s42.
