How do you maintain legal professional privilege over an independent medical report once it has been released to a worker’s GP?

Under s 90B(3) of the Workers Rehabilitation and Compensation Act 1988, an independent medical report must be released to the worker’s GP. This does not waive legal professional privilege over the report.

Raymond Benson and Kate Barwick look at what happens after release, including situations where a report may be inadvertently disclosed through GP records or referred to in Tribunal proceedings.

The DMA team got into their sports colours recently to raise money for the Fight Cancer Foundation, with a BBQ, handball competition and our AFL tipping presentation all part of the day.

We'd set ourselves a fundraising goal of $1,000 and finished with $1,092 raised. Ashlee Campbell even put her hair on the line to help us get there!

We’re pleased to introduce Katie Kells, Associate in our Estate Planning & Administration team.

Katie recently joined DMA and advises on succession planning, deceased estate administration and estate litigation, including family provision claims.

With a particular interest in succession law, Katie is also completing a Master of Laws with a focus on Estate Planning, Wills and Estates.

We’re very pleased to have Katie as part of the DMA team.

Les Winspear, aka Dr B Positive, joined us from Clown Doctors Australia to receive one of the latest grants from the Allport Bequest.

The Clown Doctors’ connection with Hobart goes back 30 years. In 1996, they spent five days visiting the Royal Hobart Hospital and St John’s Private Hospital in the aftermath of the Port Arthur tragedy, giving patients and hospital staff some welcome moments of laughter during an incredibly difficult time.

Since 2004, the Clown Doctors have had a regular presence at the Royal Hobart Hospital and now visit twice each week.

We were also very pleased to welcome Ian Lawler, incoming President of the Lindisfarne RSL Sub-Branch.

The Sub-Branch supports veterans and their families, particularly through the challenges that can follow leaving the Australian Defence Force. Its social activities provide opportunities for veterans to connect with people who understand their experiences and remain part of a community where their service is recognised and valued.

CareFlight and Vision Australia were also successful recipients of Allport Bequest grants this round, but unfortunately couldn't join us for the presentation.

Established by Henry Allport, the Allport Bequest has been supporting charitable projects across greater Hobart for more than 60 years. Through grants to local organisations, that legacy continues today.

A KitKat and a walk in the sunshine isn't a bad way to spend a Thursday lunchtime.

Yesterday was R U OK? Day, so our Wellbeing Committee left some treats out for the team and organised a lunchtime walk to get us away from our desks for a bit.

The message behind the day is a simple one: check in with the people around you.

After almost 13 years at Dobson Mitchell Allport, it’s time for us to say farewell to Amelia Higgs as she leaves DMA to join the Tasmanian Bar.

Amelia joined us in September 2013, at the beginning of her legal career. In the years since, she has become a Principal Lawyer, President of the Law Society of Tasmania, a teacher and mentor, a passionate supporter of the community and, importantly, a much-loved member of DMA.

From her work with Women’s Legal Service Tasmania and the Centre for Legal Studies to raising more than $47,000 for ovarian cancer research through Frocktober, Amelia has made an impact well beyond the matters she has worked on.

Thirteen years is a significant chapter, and Amelia has achieved an enormous amount during hers.

We’re sad to see her go, very proud to have been part of her journey, and excited to see her take this next step.

Congratulations, Amelia. We wish you every success at the Tasmanian Bar.
