David Gu's comment on the media report "Home Affairs Minister Clare O’Neil has declared Australia’s migration system is broken and is being exploited by overseas criminals, and has flagged an independent inquiry to examine revelations of widespread visa rorting linked to s*x trafficking, foreign worker exploitation and drug crime."

What about the Department of Home Affairs itself?

One of the fundamental features of our legal system is to ensure everyone is treated equally and fairly at law. The success of Australia's multicultural community and our economy depended heavily on a robust border security and comprehensive migration programs. It is deeply concerning to hear from the media recently of some unscrupulous practitioners operating in the migration profession. I believe those concerned are only a very small portion of the profession, most act professionally and ethnically. It is also important for us to recognise that every person is entitled to representation regardless of their character and history. While it is completely unacceptable for practitioners to encourage the making of false or unsubstantiated claim in visa applications, it could be professional negligence if a practitioner fails to advice a client of all visa options that may be available to them. The Australian migration system is highly complex, many relies upon the competent practitioners to inform them of the visa options and corresponding requirements so to enable them to consider whether any may be suited to their circumstances. The enticement to those who otherwise has no legitimate pathway to remain in Australia, to make vexatious visa application in my view is often the direct result of undue delay in processing by the Department of Home Affairs, Administrative Appeals Tribunal and our court system. I say the delay are result of combination of factors being lack of resources and incompetency in many decision makers at the primary level possibly due to lack of training. Delay in visa processing creates an unwarranted benefit to those who has no legitimate pathway to remain Australia by allowing them to remain longer while at the same time, it disadvantages legitimate visa applicants and undermine the attractiveness and competitiveness of our migration program to would-be applicants. Restoring confidence in Australian migration system must start within the Government and the Department of Home Affairs itself.

Clare O’Neil says criminals are getting into Australia as corrupt agents, and education institutions help traffic s*x slaves and drugs. But legitimate workers can’t find their way through a broken system.

As result of the joint venture, we are excited to welcome the migration experts from SW Migration division to the ProActive Legal family. S&W Consulting will now realign and focus on providing education advisory services to international students under its new brand name, SW Education.

Australian immigration law and visa programs are broad, complex and dynamic. While it has always been rewarding over the years to successfully resolve many complex problems, it is only fair to also acknowledge that sadly too often, through the cases that comes to us, I have witnessed many mistakes that could have been easily avoided in the first place but for poor representation or the result of DIY. The new structure of ProActive Legal allows us to have a blended team consisting of highly specialised immigration lawyers and RMA advisors. I believe this will allow ProActive Legal to be more competitively positioned to service those who often think a law firm led by an Accredited Specialist is too costly and out of their reach.

My vision, together with Sean D**g as Principal Migration Advisor of ProActive Legal and the rest of the team, is to steer and guide the firm, without any compromise on the quality of services or professionalism, to become the first point of call for anyone with migration needs whether it be a routine visa application or a highly complex situation.
