Have you stopped work because of injury OR illness? You may have a claim through your super fund.

5 things to know about Total and Permanent Disablement (TPD) and Income Protection Claims:

πŸ“Œ Most super funds provide default insurance cover. This could be for monthly salary loss or for a lump sum amount if you have stopped work and are unable to return to work due to injury OR illness.

πŸ“Œ If you have a superannuation account with more than one fund, you may have more than one insurance policy for TPD or Income Protection.

πŸ“Œ You can claim against multiple super funds and their insurers at the same time.

πŸ“Œ You can claim a TPD benefit in addition to any payments you receive from a workers compensation insurer or CTP insurer.

πŸ“Œ If you qualify for a lump sum TPD benefit you can also withdraw your super account balance.

"I want to formalise the care arrangements for our child. How do I do that?"

"What's the difference between a parenting plan and a court order?"

Here are 5 things to know about family law parenting plans and parenting court orders:

PARENTING PLANSπŸ€·β€β™€οΈ
πŸ‘¨β€πŸ‘©β€πŸ‘¦A parenting plan is a written, voluntary agreement between parents.

πŸ‘¨β€πŸ‘©β€πŸ‘¦Parenting plans are flexible and can be amended if agreed between the parents.

πŸ‘¨β€πŸ‘©β€πŸ‘¦Parenting plans are not legally binding on the parties. This means that if one parent does not abide by the parenting plan it is not immediately enforceable upon them by the FCFCOA.

πŸ‘¨β€πŸ‘©β€πŸ‘¦The FCFCOA will consider the parenting plan and its terms if a parent later initiates proceedings in the Court.

πŸ‘¨β€πŸ‘©β€πŸ‘¦ A parenting plan is great for separated parents who are able to communicate with each other effectively and are wanting further structure to their parenting arrangement.

COURT ORDERSπŸ€·β€β™€οΈ
πŸ‘¨β€πŸ‘©β€πŸ‘¦If you have reached an agreement about your parenting arrangement it can be filed as an Application for Consent orders with the FCFCOA. A Registrar of the FCFCOA will review the Application and if they find the Orders to be in the best interests of the child the Application becomes Court Orders.

πŸ‘¨β€πŸ‘©β€πŸ‘¦Court Orders are legally binding on the parents.

πŸ‘¨β€πŸ‘©β€πŸ‘¦If a parent does not act in accordance with Orders without reasonable excuse they can be penalised as contravening the orders.

πŸ‘¨β€πŸ‘©β€πŸ‘¦The penalties for contravening a Court Order can vary from make up time to jail time.

πŸ‘¨β€πŸ‘©β€πŸ‘¦If you are concerned that one of the parents may not follow a parenting plan, than a Court order is preferable.

If you would like to book an appointment to chat to our Family Lawyer about your parenting matter, call Bale Boshev Lawyers today on 02 4969 1522 or email us at [email protected].
