Just what I didnt need - to get COVID for the 2nd time.

I was symptom free all week and even this morning and then this afternoon I started feeling particularly unwell.

Sincerest apologies to anyone I have been in contact with over the past few days - if I had had any symptoms I would have tested myself and rescheduled. Hopefully nobody I have been in contact with gets it.

Family Law Property Matters

One of the major problems facing people today, when it comes to Family Law Property matters, is the generally well-meaning, but invariably incorrect, "advice" parties receive from relatives, friends, neighbours, and some professional advisors (accountants/financial planners).

Family Law is a complex area of law with no two matters being the same. There are numerous factors relevant to the determination of property "entitlements" and many unhelpful myths exist within the community, such as, "I'm entitled to half his/her super".

Family Law is often highly charged and emotive for the participants. Unfortunately, rather than parties devoting time to reaching a timely resolution to their matter, some opt to engage in conduct so as to:
(i) create detriment to the other party (usually financial);
(ii) frustrate the process (failing to comply with orders etc);
(iii) delay resolution of the matter (often with the aim of destroying the other party financially, personally, and/or professionally).

The consequence of the aforementioned conduct is that the parties' legal costs substantially and significantly escalate and the time taken to resolve their matters extends into years.

You can minimise the likelihood of this eventuality in your matter by receiving advice from a Family Lawyer at the outset. Even if you ultimately choose to represent yourself, at least you will not be starting from an untenable position arising from unrealistic expectations.

Family Court litigation is not the only option to resolve your matter. Alternative Dispute Resolution, Mediation, and Arbitration are very effective methods that should be considered prior to litigation.

Is your Estate in order?

In Western Australia, an alarming number of people do not have a current Will or Estate Plan.

You may well ask, "Why do I need a Will?"
In short, having a valid Will ensures that YOU determine who is to benefit from your estate when you pass away, as opposed to that determination being pursuant to a series of statutory provisions.

There are many myths floating about in the community such as, "My wife / husband will just get it, so I don't need one". The reality is very different.

If you die without leaving a valid Will (Intestacy), how your Estate is dealt with is determined by the Administration Act 1903 (WA) and the distribution of property is not a straightforward simple process. Invariably, the distribution of your Estate upon Intestacy would not be the same as it would if you expressed your intentions in a properly drafted Will.

You may also ask, "What is an Estate Plan"
Briefly, an Estate Plan consists of a series of documents that enable appointed persons to carry out your wishes both during your lifetime and after you pass away.

Generally an Estate Plan consists of one or more of the following:
(i) Will (incorporating Testamentary Discretionary Trusts)
(ii) Enduring Power of Attorney (EPA)
(iii) Enduring Power of Guardianship (EPG)
(iv) Advance Health Directive (AHD)
(v) Superannuation Death Benefit Nomination.
