Family Law Property Matters

One of the major problems facing people today, when it comes to Family Law Property matters, is the generally well-meaning, but invariably incorrect, "advice" parties receive from relatives, friends, neighbours, and some professional advisors (accountants/financial planners).
Family Law is a complex area of law with no two matters being the same. There are numerous factors relevant to the determination of property "entitlements" and many unhelpful myths exist within the community, such as, "I'm entitled to half his/her super".
Family Law is often highly charged and emotive for the participants. Unfortunately, rather than parties devoting time to reaching a timely resolution to their matter, some opt to engage in conduct so as to:
(i) create detriment to the other party (usually financial);
(ii) frustrate the process (failing to comply with orders etc);
(iii) delay resolution of the matter (often with the aim of destroying the other party financially, personally, and/or professionally).
The consequence of the aforementioned conduct is that the parties' legal costs substantially and significantly escalate and the time taken to resolve their matters extends into years.
You can minimise the likelihood of this eventuality in your matter by receiving advice from a Family Lawyer at the outset. Even if you ultimately choose to represent yourself, at least you will not be starting from an untenable position arising from unrealistic expectations.
Family Court litigation is not the only option to resolve your matter. Alternative Dispute Resolution, Mediation, and Arbitration are very effective methods that should be considered prior to litigation.
