📣 Major Family Law Reforms Effective 10 June 2025

Australia's family law landscape is undergoing significant changes aimed at enhancing fairness, safety, and clarity in property and financial matters following separation.

🔑 Key Changes You Should Know:

1️⃣ Economic Impact of Family Violence Considered
Courts are now required to assess how family violence, including economic or financial abuse, has affected each party's contributions and future needs during property settlements.

2️⃣ Recognition of Economic and Financial Abuse
The definition of family violence has been expanded to explicitly include economic and financial abuse, such as dowry abuse, controlling a partner's financial resources, or sabotaging their employment.

3️⃣ Treatment of Companion Animals
A new framework has been introduced for handling family pets in property disputes. Courts will consider factors like the attachment of each party or children to the pet and any history of animal abuse.

4️⃣ Mandatory Financial Disclosure
The obligation for parties to fully disclose their financial information has been elevated from court rules into the Family Law Act, reinforcing the importance of transparency in financial matters.

5️⃣ Less Adversarial Approach in Property Matters
Courts now have the discretion to adopt a less adversarial approach in property and financial cases, particularly where family violence is a factor, to better manage proceedings and evidence.

These reforms apply to all separating couples, whether their property settlement is determined by the courts or negotiated outside of court.

Not Ready for Mediation? That’s Completely Okay.

Have you ever felt like you should be ready to talk things through, but your heart just isn’t there yet?

That feeling is more common than you might think—especially during a family separation. Sometimes, the idea of sitting down for mediation feels overwhelming when emotions are still raw.

Here’s what we want you to know: Taking time to prepare yourself isn’t avoidance—it’s insight.

Mediation works best when you’re emotionally ready to engage, not when you feel pressured to just get on with it. If you’re not quite there yet, consider:

✔️ Allowing yourself the space to process emotions without guilt
✔️ Working with a counsellor to build emotional clarity
✔️ Identifying which aspects of mediation feel most overwhelming
✔️ Setting small goals before tackling bigger issues

The path through separation isn’t straightforward. Some days, you’ll feel ready to tackle the tough conversations head on. Other days, just putting one foot in front of the other is enough. What matters is finding an approach that honours where you are, while still moving forward—at your own pace.

Unsure if you're ready for mediation?

That's why we offer a free 15-minute call 07 2142 2727—an opportunity to discuss where you’re at and explore what support could help you take the next step when you're ready. No pressure, just an open conversation about your options.
