Can your skills change the split? 💼

Imagine building a business over many years with your partner by your side. One person drives the company, while the other raises the children, manages the household, and provides crucial support. Then, after separation, the company suddenly skyrockets in value.

Should the founder receive a larger share simply because success came after the relationship ended?

That was exactly the question the Court considered in Charis & Charis [2026] FedCFamC1A 92. The answer: special skills, professional qualifications, and earning capacity do influence how assets are divided—even when that success happens post-separation.

It's not just about what you own. It's about the partnership that got you there.

SHE THINKS: "I messed up in this marriage. I wasn't perfect. So obviously the courts will side with him and take my kids. He's a great dad. I'm going to lose everything. I can already see it happening. I should probably just accept it now."

Translation: Catastrophizing based on a myth she heard once.

HE THINKS: "I'm a guy going through divorce. Everyone knows the courts favor moms. I'm going to be a visitor in my kids' lives. I'll lose custody for sure. This is hopeless."

Translation: Also catastrophizing based on the same outdated myth.

HERE'S THE ACTUAL TRUTH:

Courts don't automatically favor moms. Or dads. They favor the kids.

The "best interest" standard looks at: who's involved in their lives, who can actually be there, the relationship quality, stability, and yes—sometimes the parent who's been the primary caregiver. But that could be either of you.

We've seen moms get primary custody. We've seen dads get it. We've seen 50/50 splits where both parents thrive. It all depends on what's actually best for YOUR kids—not some outdated assumption about your gender.

The difference? The parents who get good outcomes are the ones who show up prepared and focused on what actually matters to the kids. Not the ones paralyzed by a myth.

Some things that actually help:

✓ Set clear boundaries — Your co-parenting relationship is separate from your romantic relationship. Keep it professional. Business-like, even.

✓ Communicate through a neutral channel — Text or co-parenting app (like Our Family Wizard) keeps emotions out of logistics. No surprises. Just facts.

✓ Never use kids as messengers — If you have something to say to your ex, say it directly. Kids shouldn't carry that weight.

✓ Find common ground — You both want the kids to feel secure, loved, and stable. Start there. Everything else is details.

✓ Let go of controlling how they parent on their time — They don't parent like you? That's okay. Your kids will survive having two different households with two different rules. Actually, it teaches them flexibility.

✓ Show up for the kids' events—both of you — Weird soccer game on Saturday with your ex there? That's the price of being a good parent. Your kids will remember you both being proud of them.
