We've just read the alarming numbers from the first full year since NSW's Coercive Control laws came into effect.

Between 1 July 2024 and 30 June 2025, NSW Police recorded 297 incidents of coercive control across the state. Fifteen of those were right here in the Illawarra and Shoalhaven, communities where we live and work.

94% of victims were women.

The most common behaviours recorded were harassment, monitoring or tracking (59%), threats or intimidation (53%), financial abuse (48%) and shaming or humiliation (45%).

Regional NSW recorded more than double the rate of incidents compared to Greater Sydney.

Coercive control is a repeated pattern of behaviour designed to dominate, isolate and control a partner. It carries a maximum penalty of 7 years imprisonment in NSW, and courts are now required to consider the economic impact of coercive control when dividing property in a separation or divorce.

You don't have to go to court for your property settlement - mediation could work better for you.

According to Maree, mediation is almost always worth trying first, because the minute you introduce the court, you begin to relinquish control over the outcome.

When you go to court, a judge who doesn't know your family, your circumstances, or what matters most to you will make decisions that you and your former partner couldn't agree on yourselves. Sometimes that's necessary, but it's rarely the preferred option.

Mediation is faster, cheaper and keeps the decision-making where it belongs - with you.

When mediation doesn't work, or when the situation involves domestic violence, non-compliance or complex financial arrangements, that's when court intervention becomes the right path. Maree is experienced in both.

Two couples, one café, no written agreement.

In Pitak v Sudtipatudom (2025), two couples went into business together to run a café in Sydney. They were friends, they trusted each other, so they didn't think they needed lawyers.

When the relationship broke down, so did the business. The dispute ended up in the NSW Supreme Court, with both sides spending significant money in legal fees arguing over who owned what, who contributed what, and who was entitled to what share of the profits.

The plaintiffs walked away with little more than their legal bills.

The café industry is one of the most common places this story plays out, but it happens in every kind of small business. The trust is real, but the problem is that trust isn't a legal document.

Most people assume that getting divorced automatically cancels their Will. But in NSW, that's not quite right.

Under the Succession Act 2006, divorce revokes the parts of your Will that relate to your former spouse - their gifts, their role as executor, their appointment as trustee, for example. But the rest of your Will stays in place exactly as it was.

That sounds like a good thing, but it can create real problems.

If your Will was written during your marriage, there's a good chance it was structured around your life as a couple with shared assets, blended family arrangements and people you've since lost touch with. The parts that remain after divorce may no longer reflect what you actually want.

The safest thing to do after a separation is to make a new Will entirely - not just an update, but a fresh start that reflects your life as it actually is now.

⚠️ Trigger Warning - Domestic violence ⚠️

Recently, Australia's High Court made a decision that matters for every victim-survivor of domestic violence in this country.

In this case, a woman secretly recorded her husband admitting to sexually abusing her while she slept. She said she made the recording to convince herself "never to go back to him", no matter what happened.

The man was convicted in South Australia of sexually abusing his wife on two occasions. He appealed his conviction, arguing the recording should never have been admitted as evidence. The High Court disagreed.

Most secret recordings of private conversations are illegal in Australia. But the High Court ruled unanimously that her recording was lawful, because protecting a person's right to bodily safety outweighs privacy laws in circumstances like these.

His conviction was upheld. He will serve 9.5 years.

Legal experts say the ruling could extend beyond criminal trials, potentially into protection order applications as well.
