South Australia introduces a new visa

Unlike the current Entrepreneur visa, the new visa does not require $200,000 funding arrangements and the English language requirement is 5 Band score on IELTS.

South Australia has allocated $400,000 to implement a pilot program for a new visa for startup entrepreneurs seeking to establish a business in the state.

The visa was first announced in March this year, before the SA state election.

Giving an undertaking to the South Australian Liberals to pilot the visa from SA before its national rollout in 2019, Home Affairs Minister Peter Dutton said it would foster business growth and investment in Australia.

The Government said it would increase job opportunities and boost the economy by attracting startups to establish operations in Australia.

This visa will be different from the existing entrepreneurial and Business & Innovation visas as it will not require any mandatory funding outlay and an applicant only needs to demonstrate vocational English language proficiency.

With the new visa, foreign entrepreneurs and investors with an innovative idea and a supporting business plan will be able to apply for a temporary visa to establish their venture in Australia.

The applicants’ business proposals will be examined by the State or Federal Government and those successfully establishing their business venture in Australia will become eligible to apply for permanent residence.

The South Australia pilot will run over four years and 30 places allocated in the first year with the number of visas increasing every year, StartupSmart reports.

The South Australian Minister for Trade, Tourism and Investment, David Ridgway said the new visa encourages growth in the local entrepreneurial culture.

“The new visa will drive entrepreneurialism and innovation in our state, with the future potential to employ South Australians,” Mr Ridgway said.

While it’s not yet clear whether any financial requirements apply to the applicants, they must be under the age of 45 and have vocational level English which is band 5 in each of the four components of the International English Language Testing System (IELTS). They are also required to meet the health, character and financial requirements set by the Federal Government.

“We are confident that this arrangement can lead to participants applying for permanent residence in South Australia as they develop their business plans into successful enterprises creating new companies and jobs in our state,” said Mr Marshall said after the Federal Government’s announcement.

“These arrangements will also encourage more investment in those sectors of our economy with the greatest capacity to grow, including advanced manufacturing and defence technology following the Federal Government’s decision to centre the naval shipbuilding program in South Australia.”

DIBP on the 30th of September 2017 reviewed the risk rating for all countries and CRICOS Education Providers. There has been a positive change for India, Nepal and Bangladesh they have now all moved to a Risk Rating Two (2). Now that India, Nepal and Bangladesh are all Assessment Level 2 Countries meaning their English and Financial evidence are not mandatory documents for a visa application but this evidence may be required at any stage and should be made available.

Skilled Occupations Lists for 2017-18 Released

General Skilled Migration
Prior to 1 July, a single MLTSSL applied to both Employer Sponsored and General Skilled Migration programs, and also a single STSOL.

6 occupations have been removed from the list for Skilled Independent and family sponsored 489 visas as compared to the pre 1 July MLTSSL. Removed occupations include Sea Transport Professionals and Psychotherapists (removed entirely) and the occupations of Production Manager (Mining) and Anaesthetists which are still available for State/Territory Nomination.

13 occupations have been removed from the approved lists entirely - these include Senior Managers, Statisticians, Economists, Mining Engineers, Engineering Professionals NEC and Chemists.

16 occupations have been added to the State/Territory Nominated list which were not previously available - these include Air Transport Professionals, ICT Support Staff, Butchers and Retail Buyers.

Employer Sponsored Visas
The 457 visa and the ENS Direct Entry Stream share the same occupations list. The list is split into MLTSSL occupations and STSOL occupations. MLTSSL occupations result in a 457 visa valid for up to 4 years, whereas the maximum duration of a 457 visa in an STSOL occupation is only 2 years.


Compared to the lists prior to 1 July, 18 occupations have been removed entirely - these include marine transport professionals, psychotherapists, medical administrators and property associate professionals.

27 occupations have been added to the approved lists including R&D Managers, life scientists, air transport professionals, ICT Support roles, butchers, Music professionals, metallurgists and horse trainers.

22 occupations have been moved from the STSOL to the MLTSSL including senior management positions, environmental scientists and university lecturers. 2 occupations have moved from the MLTSSL to the STSOL.

Professional Year Programs
Professional Years are available for international students who have completed studies in Australia in one of the following disciplines: •Accounting
•Information Technology
•Engineering

Program Outline
The programs are at least 44 weeks in duration. This includes a 12-week internship within a host company as well as some classroom studies. The objective of the program is to enhance your employment opportunities in Australia.
Benefits of Professional Year - Migration Purposes

English Language Requirement for Skilled Migration Australia

If you are applying for Skilled Migration, you will need to prove your English language ability. The required level of English depends on the visa subclass you are applying for and there are 4 different levels of English which may be relevant:
• Superior English: 20 points in GSM points test
• Proficient English: 10 points in GSm points test
• Competent English: threshold requirement for General Skilled Migration Direct Entry
• Vocational English: threshold requirement for Temporary Residence Transition Stream
• Functional English: for secondary applicants seeking to avoid paying the English Language Charge

Vocational English
Vocational English is the required level to obtain ENS and RSMS visa through the Temporary Residence Transitional stream for people who have held a 457 visa for 2 years with the employer.
Required scores to establish Vocational English are as follows:

Changes from March 2018
From March 2018, the 457 visa will be abolished and replaced with the TSS visa. The TSS visa will be comprised of a Short-Term stream of up to two years, and a Medium-Term stream of up to four years.

The Short-Term stream will include the following criteria:
- Renewal: Capacity for visa renewal onshore once only.
- English language requirements: A requirement of an International English Language Testing System (IELTS) (or equivalent test) score of 5, with a minimum of 4.5 in each test component.
- Genuine entry: A genuine temporary entrant requirement.

The Medium-Term stream will include the following criteria:
- Renewal: Capacity for visa renewal onshore and a permanent residence pathway after three years.

- English language requirements: a requirement of a minimum of IELTS 5 (or equivalent test) in each test component.

Eligibility criteria for both streams will include:
- Work experience: at least two years’ relevant work experience.
- Labour market testing (LMT): LMT will be mandatory, unless an international obligation applies.
- Minimum market salary rate: Employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold requirements.1
- Character: Mandatory penal clearance certificates to be provided.
- Workforce: A non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers.
- Training requirement: a strengthened training requirement for employers to contribute towards training Australian workers.

Why are these changes being made?
These measures will sharpen the focus of Australia’s employer sponsored skilled migration programmes to ensure they better meet Australia’s skills needs, increase the quality and economic contribution of skilled migrants and address public concerns about the displacement of Australian workers.
Who is affected?
Current 457 visa applicants and holders, prospective applicants, businesses sponsoring skilled migrants and industry. Existing 457 visas will continue to remain in effect.
457 visa applicants that had lodged their application on or before 18 April 2017, and whose application had not yet been decided, with an occupation that has been removed from the STSOL, may be eligible for a refund of their visa application fee. Nominating businesses for these applications may also be eligible for a refund of related fees.
