Important update for some onshore Aged Parent and Contributory Aged Parent visa applicants. There is a known issue affecting a specific group: cases where the primary applicant has passed away and the secondary applicant was not of qualifying age when the application was lodged.

A number of these cases have been refused. While these refusals seem inconsistent with previously understood policy, under the current law they appear to be lawful. A review is underway, but there is a real chance that decisions already made may not be reopened or overturned, even if policy changes in future.

If you've received a refusal in these circumstances, it may be worth looking at alternative options now rather than waiting on the review outcome. Contact us to discuss how this may affect your situation.

If you're planning to challenge a refused student visa decision, there's an important change to be aware of. From 1 June 2026, most applications to review a student visa refusal will be decided based on the documents and written submissions provided β€” rather than through an in-person hearing.

This means the quality and completeness of your written material now carries even more weight, as there may not be a chance to explain your situation verbally before a decision is made.

If you have a student visa refusal you're considering reviewing, get in touch with us to discuss what this change means for your case. πŸ“„

🧭 Most applicants planning skilled migration to Australia don't realise there's a free government tool that shows exactly which occupations are in demand β€” and where.

Jobs and Skills Australia has released the JSA Atlas β€” an interactive platform with national and regional labour-market data.

Here's what it shows:
βœ… Employment trends across occupations
βœ… Current vacancies and skills shortages
βœ… Training pipeline data
βœ… Regional workforce demand

Why this matters if you're planning a 482, 186, 491 or 190 visa:

In our practice, the strongest skilled migration cases are built on real labour-market evidence β€” not assumptions. The Atlas reveals which regions have genuine shortages in your occupation, which can shape:

β€’ Where to target a Skills in Demand (482) employer
β€’ Whether a regional 491 makes more sense than a 190
β€’ How to position a state nomination submission

Use government data, not anecdotes, to plan your move to Australia.

πŸ‡¦πŸ‡Ί Partner visa (subclass 309) update: you may no longer need to be offshore at grant.

Here's what's causing confusion in our casework. The current Procedural Instruction for the offshore Partner visa (subclass 309) still says an applicant must be OUTSIDE Australia when the visa is granted.

That policy is out of date.

Regulation 309.412 was amended on 24 November 2023. Since that change, a subclass 309 visa can be granted whether the applicant is onshore or offshore at the time of decision. The procedural instruction hasn't been updated to reflect this.

What this means for you:
βœ… If you're already in Australia on a bridging or substantive visa while your 309 is pending, you do not automatically need to depart for grant.
βœ… Relying on outdated policy can lead to unnecessary international travel, cost and family separation.
βœ… The Migration Act and Regulations prevail β€” always verify against current legislation.

If you've been told you need to leave Australia for your offshore Partner visa to be decided, speak to a registered migration agent about your situation before booking flights.

πŸ“‹ Important update for partner visa applicants.

The Subclass 309 (offshore partner visa) can be granted whether the applicant is inside OR outside Australia. This has been the law since November 2023.

But government policy documents on LEGENDcom still say the opposite β€” that you must be overseas at the time of grant.

This disconnect matters. Agents who rely on policy without checking the actual legislation may be giving wrong advice β€” including telling clients they need to leave Australia before the visa is granted.

At VisaTasker, I work from the Migration Act and Regulations β€” not outdated procedural instructions.

If you have a partner visa in progress and want certainty about your obligations, speak to a registered migration agent about your situation.

πŸ“‹ Partner visa myth-buster.

If you're a subclass 309 applicant and you've been told you must be outside Australia when your visa is granted β€” that may no longer be accurate.

Regulation 309.412 was amended on 24 November 2023, removing the requirement to be offshore at the time of grant. A subclass 309 visa can now be granted whether the applicant is onshore or offshore.

In our practice, we've seen outdated information still circulating β€” including in some official policy guides. Always verify the current legislation, not just policy summaries.

If you're waiting on a 309 grant and uncertain about your travel plans or location, speak to a registered migration agent before making any decisions.

πŸ“‹ Partner visa applicants β€” this is one that catches people out.

If you're applying for an offshore partner visa (subclass 309), official policy still states you must be OUTSIDE Australia at the time of visa grant.

The law says otherwise.

Regulation 309.412 was amended on 24 November 2023. Since then, a subclass 309 visa can be granted whether the applicant is onshore or offshore at time of grant.

The procedural instructions on the department's policy database haven't been updated to reflect this change. Policy is an interpretive guide β€” it's not authoritative. The Migration Regulations are the primary source of law.

This matters if you're on a 309 application and your situation has changed β€” for example, you've entered Australia while waiting for a decision.

Speak to a registered migration agent who reads the legislation, not just the policy. βœ…

MYTH: Student visa holders in Australia can work as many hours as they want ❌

This one comes up a lot β€” and it's a costly misconception.

The reality? If you're on a Student visa (subclass 500), you're generally limited to 48 hours per fortnight while your course is in session. That's roughly two full-time days per week β€” not unlimited.

βœ… What you CAN do:
- Work unlimited hours during official semester breaks and course holidays
- If you're enrolled in a Master's by research or Doctoral degree, the 48-hour cap doesn't apply β€” you can work unrestricted hours year-round

⚠️ Why this matters:
Breaching your work conditions isn't just a fine β€” it can lead to visa cancellation. And a cancelled student visa can seriously impact your future visa options in Australia.

A lot of students don't find out until it's too late. Your employer may not even know the rules.

If you're unsure about your visa conditions or how they affect your work rights, speak to a registered migration agent before you start a new job or take on extra shifts.

BREAKING: Permanent Parent Visa Applications Move Online β€” From Tomorrow

From 22 April 2026, four permanent parent visa subclasses must be lodged online via ImmiAccount. Paper applications will only be accepted in exceptional circumstances under LIN 26/005.

Moving to online lodgement from 22 April:
- Subclass 103 (Parent visa)
- Subclass 804 (Aged Parent visa)
- Subclass 143 (Contributory Parent visa)
- Subclass 864 (Contributory Aged Parent visa)

Still paper-only:
- Subclass 173 (Contributory Parent Temporary)
- Subclass 884 (Contributory Aged Parent Temporary)

Important: Mailing a paper application without the Department's explicit written authorisation may result in it being returned as invalid β€” losing your place in the already lengthy processing queue. Processing timeframes are unchanged.

Preparing a parent visa application? Make sure your ImmiAccount is set up before lodging. Need guidance? Book a Consultation with VisaTasker.
