🇦🇺 Partner visa (subclass 309) update: you may no longer need to be offshore at grant.

Here's what's causing confusion in our casework. The current Procedural Instruction for the offshore Partner visa (subclass 309) still says an applicant must be OUTSIDE Australia when the visa is granted.

That policy is out of date.

Regulation 309.412 was amended on 24 November 2023. Since that change, a subclass 309 visa can be granted whether the applicant is onshore or offshore at the time of decision. The procedural instruction hasn't been updated to reflect this.

What this means for you:
✅ If you're already in Australia on a bridging or substantive visa while your 309 is pending, you do not automatically need to depart for grant.
✅ Relying on outdated policy can lead to unnecessary international travel, cost and family separation.
✅ The Migration Act and Regulations prevail — always verify against current legislation.

📋 Important update for partner visa applicants.

The Subclass 309 (offshore partner visa) can be granted whether the applicant is inside OR outside Australia. This has been the law since November 2023.

But government policy documents on LEGENDcom still say the opposite — that you must be overseas at the time of grant.

This disconnect matters. Agents who rely on policy without checking the actual legislation may be giving wrong advice — including telling clients they need to leave Australia before the visa is granted.

📋 Partner visa applicants — this is one that catches people out.

If you're applying for an offshore partner visa (subclass 309), official policy still states you must be OUTSIDE Australia at the time of visa grant.

The law says otherwise.

Regulation 309.412 was amended on 24 November 2023. Since then, a subclass 309 visa can be granted whether the applicant is onshore or offshore at time of grant.

The procedural instructions on the department's policy database haven't been updated to reflect this change. Policy is an interpretive guide — it's not authoritative. The Migration Regulations are the primary source of law.

This matters if you're on a 309 application and your situation has changed — for example, you've entered Australia while waiting for a decision.

MYTH: Student visa holders in Australia can work as many hours as they want ❌

This one comes up a lot — and it's a costly misconception.

The reality? If you're on a Student visa (subclass 500), you're generally limited to 48 hours per fortnight while your course is in session. That's roughly two full-time days per week — not unlimited.

✅ What you CAN do:
- Work unlimited hours during official semester breaks and course holidays
- If you're enrolled in a Master's by research or Doctoral degree, the 48-hour cap doesn't apply — you can work unrestricted hours year-round

⚠️ Why this matters:
Breaching your work conditions isn't just a fine — it can lead to visa cancellation. And a cancelled student visa can seriously impact your future visa options in Australia.

A lot of students don't find out until it's too late. Your employer may not even know the rules.

BREAKING: Permanent Parent Visa Applications Move Online — From Tomorrow

From 22 April 2026, four permanent parent visa subclasses must be lodged online via ImmiAccount. Paper applications will only be accepted in exceptional circumstances under LIN 26/005.

Moving to online lodgement from 22 April:
- Subclass 103 (Parent visa)
- Subclass 804 (Aged Parent visa)
- Subclass 143 (Contributory Parent visa)
- Subclass 864 (Contributory Aged Parent visa)

Still paper-only:
- Subclass 173 (Contributory Parent Temporary)
- Subclass 884 (Contributory Aged Parent Temporary)

Important: Mailing a paper application without the Department's explicit written authorisation may result in it being returned as invalid — losing your place in the already lengthy processing queue. Processing timeframes are unchanged.

URGENT DEADLINE — Victoria State Nomination Closing 28 April 2026

Victoria's Live in Melbourne program will stop accepting new Registrations of Interest (ROIs) at 4:00 PM AEST on 28 April 2026 — that's 7 days away.

Key facts:
- 3,400 nomination places allocated for 2025-26 (down 32% from last year)
- 2,700 places for Subclass 190 (permanent Skilled Nominated visa)
- 700 places for Subclass 491 (provisional Skilled Work Regional visa)
- Demand is running at 3x available places — competition is intense
- Minimum 65 points required, but English proficiency, salary, and occupation are also ranking factors

If you miss the cut-off, your next options are employer-sponsored pathways (such as Subclass 482) or waiting for the 2026-27 program, typically announced in August.

MYTH: "If I marry an Australian citizen, I get permanent residency automatically." 🇦🇺

The truth? Marriage to an Australian citizen (or permanent resident) gives you the right to APPLY for a partner visa — not automatic permanent residency.

Here's what the process actually looks like:

✅ Wait — processing can take 12–24+ months
✅ After 2 years, apply for the Permanent Partner Visa (subclass 801 or 100)
