What is Conveyancing?

Conveyancing is the process that deals with the transfer of ownership of property from a seller to a buyer.

This process may appear easy, however, it is worth noting that property law and conveyancing are quite complex areas of the law that require adequate knowledge in numerous legal principles. You may be expected to have knowledge regarding mortgages, covenants, easements, caveats, property titles, tenancy agreements, your local council regulations and zoning for example.

A brief summary of the Conveyancing process.

1. The first step generally involves the drawing of the Contract of Sale. This step involves the purchaser obtaining legal advice needed to review the Contract of Sale. Furthermore, the purchaser needs to arrange the necessary inspection and/or the necessary loan arrangements before signing the Contract of Sale.

2. The Contract of sale may be immediately binding after it has been signed by both the Vendor and Purchaser. Both parties need to be fully aware of the circumstances of the sale that may affect the legality of the contract at this stage. It is worth noting that both parties may have a cooling off period or may have the ability to withdraw from the Contract of Sale under certain conditions that may be stated within the Contract of Sale. It is pivotal that both parties fully comprehend the exact terms and conditions stipulated within the Contract of Sale.

3. There is a period between the Contract of Sale becoming binding and the Contract of sale being settled that allows the purchaser to finish off all the checks needed for the transfer to be fully completed. The purchase may be required to conduct important property checks prior to settlements, organise the payment of the stamp duty, arrange the necessary insurance covers needed and finalise their loan arrangements. The vendor during this time may be required to ensure that their bank discharges any necessary mortgages pertaining to the property and also arrange their evacuation from property if necessary.

4. Prior to settlement, the vendor and purchaser may agree to adjust the payment price to cover for pending council and water rates as well as some other pending costs which may be allowed for within the Contract of Sale.

5. On settlement day, everything pertaining to the property including the keys will be handed over to the purchaser and property would then be considered settled.

6. A new owner of the property will be required to be registered as the owner of the property on the title and numerous governmental bodies will need to be alerted about the change of ownership.

The NT DAMA is an employer-sponsored visa scheme. Employers must apply to access the NT DAMA for the occupations and number of workers they require. They then nominate the workers they have identified to apply for a visa. The NT Government does not connect those interested in a visa with employers who are endorsed under the NT DAMA or may be interested in applying to be endorsed under the NT DAMA– One would need to seek advice or do this research yourself.
