“Why doesn’t the Court just order 50/50?”

This is one of the most common questions I get — and this case shows exactly why.

In Beumers & Stoica [2025], the Court had to decide:

* Should a child spend equal time with both parents?
* Or remain primarily with one parent?

Despite the father pushing for equal time, the Court said no.

Why?

Because in parenting matters, the law is clear:
👉 It’s not about fairness between parents
👉 It’s about what is in the best interests of the child

In this case, the Court focused on:
✔️ The child’s emotional wellbeing
✔️ Exposure to conflict and family violence
✔️ The child’s relationship with each parent
✔️ Each parent’s ability to meet the child’s needs

The result?
➡️ The child lives with the mother
➡️ The father spends alternate weekends + holidays
➡️ The mother has sole decision-making
