On 7 April 2020, the Prime Minister announced that it had been agreed by the National Cabinet that a mandatory code for commercial tenancies will be legislated and regulated in each state and territory. As commercial tenancies are regulated at the state level, the code will be enacted on a state by state basis.

The code will apply to tenancies where the tenant or landlord is eligible for the Job Keeper Program, introduced by the Federal Government (That being, in a position of distress and where the turnover is less than $50 million).

The good faith principles of leasing will include;
1. Landlords cannot terminate the lease or draw on a tenant's security;
2. Tenants must honour the lease and the obligations imposed under the lease;
3. Landlords are required to reduce rent proportionate to the trading reduction in the tenant's business, over the course of the pandemic period. This can be a mix of waiver or deferral, with waiver/deferral at least 50%. Deferrals must be covered over the balance of the lease term and in no fewer period than twelve months.
4. It does not apply to agents or licensees.
5. The arrangements will be overseen through a binding mediation process.
