Deleting a text doesn’t delete your problem.

Here’s what most people get wrong about digital evidence in family law:

✔️ Messages can often be recovered - or already saved by the other party, a provider, or a backup
✔️ Private messages can still be tendered as evidence if they’re relevant, even from a personal account
✔️ A screenshot isn’t automatically accepted - the other party can challenge whether it’s genuine, complete or correctly dated
✔️ Tone, frequency and timing matter too, not just the words on the screen

Before you rely on a message, get advice on how it will actually hold up.

“It’s not abuse unless someone gets hurt.”

Not true.

Family violence isn’t always physical. Australian family law recognises economic and financial abuse as a serious form of family violence. Controlling your finances, restricting access to money, forcing debt, or preventing you from earning an income can all be evidence of a pattern of coercive control.

Family violence isn’t always visible. Understanding your rights is the first step towards protecting them.

One of the biggest divorce myths?

That someone has to be “at fault.”

Not in Australia.

Our family law system is based on no-fault divorce, meaning the Court doesn’t investigate who ended the marriage or why.

The key legal requirement is that the marriage has broken down irretrievably, with the parties having been separated for at least 12 months before filing for divorce.

Knowing the law can help you make informed decisions and move forward with confidence.

If you’re considering separation or divorce, our team is here to provide clear, practical advice tailored to your circumstances.

Meet Leah — the glue that holds Delaney Featherston Lawyers together. 🤍

As our legal assistant and social media manager, Leah wears more hats than most people realise — from keeping matters running smoothly behind the scenes, to being the friendly voice you’ll often hear first when you call, to bringing our little corner of Instagram to life.

She’s got a knack for making people feel at ease, whether that’s a client who’s had a tough week or a co-founder asking for “just one more edit” on a caption. (Sorry, Leah.)

We’re lucky to have her on the team — organised, warm, and always five steps ahead.

The Court doesn’t flip a coin to decide 50/50 parenting.

Every parenting matter is different.

There is no automatic rule that children should spend equal time with each parent.

Instead, the Court carefully considers a range of factors, including:

✔️ The child’s best interests
✔️ Any safety concerns
✔️ The child’s views (where appropriate)
✔️ Each parent’s ability to meet the child’s needs
✔️ Whether the arrangement is practical for everyone involved

Every decision is made with one priority in mind:
What’s best for the child.

Every client walks in carrying more than just paperwork.

They’re carrying stress, uncertainty, and big decisions they didn’t expect to be facing. Our job is to meet that with steady, clear guidance — not just legal know-how.

I’m Kristina, Senior Lawyer and Co-Founder of Delaney Featherston Lawyers.

What I love most about this work is walking alongside people at some of the hardest moments in their lives and helping them come out the other side with a plan, and a sense of control again. Whether it’s a family law matter, an estate, or a property transaction, I bring the same care and attention to every client I work with.

Building Delaney Featherston Lawyers with Meagan has been one of the most rewarding parts of my career, and I’m proud of the practice we’ve created together.

“We hear it all the time: ‘50/50 is just how it works now, right?’

Not quite. There’s no automatic formula in family law — every arrangement is based on what’s actually best for your kids, not a default split.

These are some of the biggest assumptions we come across, and what the law really looks at. 👆

Got questions about parenting arrangements? Our door (and DMs) are always open. 💚
