Breaking - Partner Visa Change Bill: Only Subclass 309 Visas Affected

Details of the anticipated bill by MP Julian Hill were released today which target proposed changes to the partner visa program to avoid mandatory offshore activity due to the COVID19 pandemic to a single visa.

The "Migration Amendment (Common Sense Partner Visa) Act 2020", a private members bill by MP Julian Hill, targets a single visa - the subclass 309 temoprary partner visa, and alters the legislation to enable that visa to be granted regardless of whether the applicant is onshore in Australia or offshore.

Currently applicants for this visa must be offshore at the time of grant of the visa.

While the bill, if enacted, would address travel restriction concerns for subclass 309 applicants, this bill does not extend the benefit of onshore grants to other visa subclasses including Prospective Marriage (subclass 300), Adoption (subclass 102), Child (subclass 101) and Dependent Child (Subclass 445) visas that the Department of Home Affairs has indicated in a statement on its website will be changed in 2021 to allow visa grant while onshore in Australia:
"It is intended that changes will be implemented in early 2021 that would allow certain family visas, which have been applied for outside Australia, to be granted while the visa applicant is in Australia. This temporary concession will be for people who are in Australia and are not able to travel offshore to be granted the visa due to COVID-19 related border closures." The Australian government today announced further details about the shock changes to the Partner Visa program regarding adding English language testing. Acting Immigration Minister Alan Tudge has said that the English changes are intended to apply from the middle of 2021, and will be implemented at the second (permanent resident) stage of partner visa applications.

According to media reports Tudge stated today, "What this will mean is that we will require an applicant and a sponsor to have met functional level English or to have at least made reasonable efforts to lean English. And by reasonable efforts we mean for most people that would be doing about 500 hours of free English language classes."

The announcement was met with relief by many in the community including migration practitioners, however the imposition of this additional requirement still remains a potential obstacle to migrants, especially those who may not be able to pass the required English test and who may for any number of reasons including family responsibilities, health, employment or other reasons be unable to progress through the English language classes.

What remains unclear is whether there will be a "buy-out" available if applicants or their permanent resident sponsors are unable to provide evidence of functional English or take 500 hours of English language classes, with one major Sydney newspaper publishing a story yesterday that seemed to indicate that partner visas would be refused if the English language requirements could not be met.

It is also unclear at the moment whether exemptions will be made for people who hold certain passports from English-speaking countries or have had a specified level of English education in other countries, whether disadvantaged applicants such as victims of family violence will be held to the same English requirement, and how situations will be handled when an applicant passes the English requirement but the sponsor does not.

Coming - Flexible Arrangements for 485 Visa Holders

Home Affairs announced flexibility with the arrangements pertaining subclass 485 visa.

As part of the response to COVID 19 Pandemic, the Department have changed the requirements for a Temporary Graduate (subclass 485) visa for those who have been impacted by COVID-19:

online study undertaken outside Australia as a result of COVID-19 travel restrictions will count towards the Australian Study Requirement for existing and new student visa holders
This change is available now.

graduates affected by COVID-19 travel restrictions will be able to apply for and be granted a Temporary Graduate visa outside Australia (where they have met all the requirements).
This change is not available yet, however, the change is expected to be implemented in the near future.

In addition to the above, the Department of Home Affairs confirmed flexible arrangements for providing English language test results for the purpose of this visa.

As many would be aware, evidence of English is time of application criteria. Where it is not possible for a student to complete English language test, the Department will accept the test results post lodgement.

Department of Home Affairs Priority Migration Skilled Occupation List (PMSOL)

The Department of Home Affairs (DoHA) has published the Priority Migration Skilled Occupation List (PMSOL). It includes 17 occupations from critical sectors roles in Australia's COVID-19 response. Nomination and visa applications with an occupation listed on the PMSOL will be given priority processing. All other skilled occupation lists will remain active, but the PMSOL occupations will take priority. The list is temporary and is subject to change without prior notice.
