Separation and Court proceedings can be some of the hardest times for families, especially for children. The Federal Circuit and Family Court of Australia (FCFCOA) has recently launched Kids’ Corner, a new online space with resources and short videos to help children understand what happens when families go to court.
This is supported by the new Children’s Charter, a commitment from the courts to put kids at the centre of decision-making. This is an attempt to ensure their safety, dignity and wellbeing are prioritised.
Under the Children’s Charter:
1. Children have the right to be the top priority.
Every decision the Courts make must focus on what is best for them. Their safety and needs are the most important considerations.
2. Children have the right for their views to be heard.
They are entitled to share their thoughts and feelings about what is happening in their lives. The Courts will listen carefully, while recognising it is also valid for a child to choose not to express a view.
3. Children have the right to understand what is happening.
They are entitled to receive all important information in a way that makes sense for their age, maturity and circumstances.
4. Children have the right to feel safe within the Court process.
Any places they attend and any professionals they engage with as part of the Court process should ensure they feel comfortable, respected and safe.
The Kids’ Corner website includes simple, age-appropriate explanations and animations like “What happens when a family goes to Court?” and “What is a Family Expert?” to help kids understand what’s happening and why.
