A POTHOLE YOU CAN AVOID: Assuming the property will be empty when you get the keys. 🏡

If you’re buying a property in Tasmania with plans to move straight in, don’t automatically assume you’ll receive vacant possession at settlement.

Tasmania’s 2026 Standard Form Contract specifically requires the contract to state what the buyer will receive on completion. Either vacant possession, the right to receive rent and profits under an existing lease, or another agreed arrangement.

In other words, a property can be sold while it’s still tenanted.

Before signing, check the “Availability” section of the contract and make sure it matches what you actually need. If you’re expecting an empty home on settlement day, you want that clearly dealt with in the contract, not assumed.

Buyer: “Settlement is still a few weeks away… I’ll sort the insurance later.” 😌

Contract: “Risk of accidental damage may pass to you before you actually get the keys.” 👀🔥

That’s why buyers shouldn’t leave insurance until the last minute.

Under Tasmania’s Standard Conditions of Sale, risk passes at the earlier of possession or completion, so it’s important to understand when your cover should begin.

One very important thing most buyers don't know:

Your deposit doesn’t normally go straight to the seller. 💰🏡

Under Tasmania’s Standard Form Contract, the deposit is paid to the nominated Deposit Holder and held as a stakeholder rather than simply being handed to the seller when the contract is signed. The standard conditions provide for the purchaser to authorise release of that deposit as part of completion.

So when you pay a property deposit, it’s not just a casual transfer of money to the person selling the home. It forms part of a legally structured transaction with specific rules around how it is held and released.

It’s another reason why understanding exactly what you’re signing and where your money is going - matters.

Under Tasmania’s Property Agents and Land Transactions Act 2016, there is no general requirement to disclose defects in the quality of a property for sale. CBOS specifically advises buyers to take a “buyer beware” approach and recommends proper due diligence, including a pre-purchase building inspection.
