The current Australian labour shortage issue means there is no better time than now to apply for a skilled visa.

According to a report delivered by The Joint Standing Committee on MIgration, half a million migrants have left Australia since the COVID-19 pandemic hit the nation, many of whom were skilled workers.

A lack of skilled migrants and near-record-low unemployment has resulted in major labour shortages.

If you look into the local job seeking publications or media, or talk to people in nearly all industry sectors including hospitality, accountants, lawyers, construction, retail, beuaty services etc., they are all facing major labour shortages.

Now has to be one of the best time to apply for a skilled visa to come to Australia. 😎

Having said that, employers still generally prefer applicants to have local experience so your first job in Australia is argubly still your critially important first step.

What is the upper age limit of including a child in a family visa application?

Generally speaking:
1. Children aged 18 and under are automatically considered dependent on you.
2. If you’re looking to include your children who are between 18 years and 23 years older however, you will need to show evidence as to how they are dependent on you. The Immigration Department will consider the following factors:
2.1 the child is, and has been for a substantial period immediately before that time, wholly or substantially reliant on you for financial support for his or her basic needs for food, clothing and shelter; and
2.2 the child’s reliance on you is greater than any reliance by the child on any other person, for financial support to meet his or her basic needs for food, clothing and shelter.
3. For children who is older than 23, you will need to prove that the child is wholly or substantially reliant on you for financial support because the child is incapacitated for work due to the total or partial loss of bodily or mental functions.

You should be aware that some visas do have other set age restrictions . It is important that you understand the regulations that apply to the visa you are applying for.

What happen if I cannot comply with the 'First Entry Date'?

If you have been granted a visa in Australia, you will have noticed that there is a 'First Entry Date' on your approval letter. In today's COVID-19 pandemic environment, what happens if you cannot come to Australia by this date?

As you know, each visa has its own specific conditions, and one of them is to require a visa holder to enter into Australia by a specific date. If you cannot meet this date, then it means you have breached a visa condition and this may result in cancellation of a visa. However, this cancellation visa is discretionary (and not automatic) which means that the Immigration Department will consider this on a case by case basis. Generally speaking, the Immigration Department will consider:

1. Whether the reason for your delay is/is not within your control?
2. How long has the delay been (i.e. the time period between your actual first date of entry and the required date of entry)?
3. Have you notified the Immigration Department beforehand? This is an important step, and at Evolve Advisory, we are happy to review your situation and prepare an effective response to the Immigration Department to avoid an adverse consequence of cancellation of visa.

What are the latest 2022 updates for student and temporary visa holders? 🤔

In the joint media release on 19 January 2022, the Australian Government has announced that the temporary removal of the working hours limitation for student visa holders across all sectors. This concession also applies to secondary student visa holders. The Department has announced that this measure will be reviewed in April 2022.

On 18 February 2022, certain Temporary Graduate (subclass 485) visa holders will have their visas extended to 30 September 2022. The visa extension is free and will occur automatically. The visa extension will include family members that were included in the original Temporary Graduate visa. Visa holders eligible for an extension will be notified directly by the Department.

The validity period for Temporary Graduate (subclass 485) visa granted to Masters by coursework graduates is now being increased from 2 to 3 years. Similarly, the visa validity period for the Subclass 485 Graduate Work stream visa granted from 1 December 2021 is also temporarily increased to 24 months from 18 months.

Is this the next biggest Hong Kong migration wave since 1990s?🤔

An official announcement was made on 28 October 2021 that two new visa streams will be created specifically for Hong Kong nationals to gain permanent residency (PR) in Australia.

The two visa streams are much simpler than the other existing visa streams.

Follow 1-2-3 steps to get your Australian PR🐨:

Step 1. Apply for a temporary visa through one of the existing temporary visa streams 485, 482 or 487 (each a Qualifying Temporary Visa). This Qualifying Temporary Visa will last up to 5 years (which is significantly longer than the usual duration for applicants who apply for the same visa steams but are from other jurisdictions).

Step 2. Come and live in Australia and substantially comply with the conditions of the Qualifying Temporary Visa.

Step 3. Apply for one of the newly created PR visa streams, namely:
a. subclass 191 (Hong Kong (regional) stream) after holding the Qualifying Temporary Visa for a continuous period of at least 3 years; or
b. subclass 189 (Hong Kong stream) after holding the Qualifying Temporary Visa for a continuous period of at least 4 years.

The new PR streams are open for application from 5 March 2022. 🏃💼🧳👜
