Are you selling property in New South Wales? The agency agreement is usually the first legally binding document you sign.

Here’s what’s actually in it - the commission and what triggers it, the marketing costs, how long the agent has the job, the estimated selling price, and whether you still owe commission if the sale falls over.

You get one business day to cool off. And if you switch agents without ending the first agreement properly, you can be up for commission twice.

Your contract for sale has to be prepared before the property is advertised, so you’ll be talking to a lawyer anyway – send the agency agreement through at the same time.

You’ve settled on the property. Then you spot the crack, the leak, the issue nobody mentioned. Under Australian property law, buyer beware generally means the risk shifts to you once settlement happens but there are important exceptions. Watch on to find out where you might still have options, and what to do before signing your next contract.

Joint tenants or tenants in common do you know the difference?

The way you hold title to a property affects far more than paperwork it determines what happens to your share if something happens to you.

Getting this structure right matters, especially if you’re buying with a partner, a sibling, a business partner, or blended families. It’s a decision worth getting proper legal advice on before you buy, and any time your circumstances change.

Have questions about how your property is currently held? Get in touch with our team at CML lawyers we’re here to help.

It has come to our attention that there are scammers in the area acting under the guise that they have been sent to your home by 'local real estate' for a walk through.

Neither Alicia or Chris, will ever send clients to your home without one or both of us being in attendance or issue any contact details to prospective purchasers or sellers. Do not allow anyone into your home under this pretense.

This is a serious police matter so we ask you to be vigilant and help us keep our community safe.

Thankyou.
