Before no-fault divorce, ending a marriage in Australia could involve private detectives, staged photos and hotel receipts 🕵️

Under the Matrimonial Causes Act 1959, couples generally could not simply agree to divorce. A person had to establish one of the legal grounds set out in the Act, such as adultery, desertion, cruelty and habitual drunkenness. There was only one 'no-fault' ground: separation for more than five years.

That led to some unusual situations.

Accounts describe people using photographs taken by private investigators as evidence to prove fault, and even instances where couples reportedly colluded to bring their circumstances within one of the available grounds.

The Family Law Act 1975 changed that by introducing no fault divorce.

Today, the Court does not need to decide who caused the marriage to end. The sole ground is that the marriage has broken down irretrievably, demonstrated by at least 12 months of separation.
