Today was a very special day for our Renaed, as she was admitted to practice as an Australian Legal Practitioner. I (Renee) was honoured to move Renaed’s admission. Standing in the beautiful old Banco Court at the Supreme Court, listening to all the candidates swear in their admission and viewing the immensely proud parents and family, the experience was one to remember. What Happens if I die without a Will - Does the Government get my Estate?

We are asked this question all the time. If you die without a Will, legislation decides who will receive your estate, with the Government being one of the last entities to be entitled to your estate.

Generally speaking, if you die without a Will and you are married or otherwise in a domestic partnership (not married), your partner will receive your entire estate. If you have children, your children will not receive your estate as it all will go to your partner.

If you die without leaving any spouse (married or otherwise) and you leave children then your children will equally share in your estate, being entitled to receive at the age of 18 years.

The above instances may work, but if you are married and not divorced, and you die without leaving a Will your married spouse will receive your estate. This is something that you probably don't want to happen.

Further you may be in a relationship, not married, and you have children from a prevoius marriage. If you die without leaving a Will your current partner will receive your entire estate and not your children.

The only way to ensure your estate is gifted to those you want to receive, is by preparing a properly prepared and drafted legal Will.
