→ No protection if the document is executed incorrectly or lacks essential components — and invalid Wills are more common than you'd think
→ Online kits don’t address complex situations
→ No professional review of your specific circumstances or of whether your assets will actually get captured by your will

While online will kits may seem cost effective, the potential legal issues and disputes can far outweigh any savings and may leave loved ones left to clean up matters that are more complex than they needed to be.

Power of Attorney vs Enduring Guardian — what's the difference?

Two different documents. Both essential. 📄

ENDURING POWER OF ATTORNEY:
→ Appoints someone to manage your financial and legal decisions
→ Covers bank accounts, property, investments and legal transactions
→ Operates while you're alive — and if you lose capacity
→ Can be general (immediate) or enduring (continues if incapacitated)

APPOINTMENT OF ENDURING GUARDIAN:
→ Appoints someone to make health and lifestyle decisions
→ Covers medical treatment, where you live, how you're cared for
→ Only operates when you've lost capacity to decide for yourself

Here's the key: they cover completely different things. You need both.

And here's the thing most people don't know, without these in place, your family may need to apply to a court or tribunal for authority to act for you — even in an emergency.

What is an Enduring Guardian — and why does everyone need one?

An Enduring Guardian is the person you appoint to make health and lifestyle decisions on your behalf if you lose capacity. This may include:

Without one, your family may need to apply to NCAT for permission to act for you — a process that takes time, costs money and creates stress at exactly the wrong moment.

FAQ - How often should I update my Will?
