The Fair Work Commission has dismissed a general protections application involving a worker who attended an unpaid trial shift at a bakery. The decision is a useful reminder that unpaid trials must be short, supervised and limited to assessing the person’s suitability for the role. If a trial goes beyond a genuine skills assessment, the worker may be treated as an employee and may be entitled to minimum wages and other employment entitlements.
