Today’s the day. The AML/CTF Act is now in effect for real estate agents.
If you’ve been preparing for this, well done. If you’re not quite there yet - you still have options.
The 28-day enrolment window with AUSTRAC is now open. You have until 29 July to register as a reporting entity. If that’s not done yet, it’s the immediate priority.

7 days left until commencement of the AML/CTF. One of the most common questions we’re hearing from agents: “Do I have to do all of this compliance work myself?”

The short answer is no - and here’s why.

The AML/CTF Act includes a mechanism called a reliance agreement. It allows one reporting entity to formally rely on customer due diligence conducted by another. For agents who work with a conveyancer on every transaction - which is every residential sale or purchase - this is genuinely useful.

The due diligence work is already happening on the conveyancing side. A reliance agreement means you build on that rather than duplicating it. The compliance work happens once, not twice.

But remember: a reliance agreement doesn’t replace your own AML/CTF Program. You still need that, and you remain responsible for your own obligations. But used properly, a reliance agreement is one of the most practical ways to manage the verification piece without reinventing the wheel on every transaction.

One week out. Two quick things for agents heading into 1 July.
First: if your agency doesn’t have a trust account and you need a deposit held - we may be able to help. But there are steps that need to happen before any funds come into our trust, and that conversation is much easier to have now than in the middle of a transaction. Get in touch.

Second: if your AML/CTF Program isn’t in place yet - the honest position is that time is short, but it’s not gone. The 28-day enrolment window after 1 July (closing 29 July) gives you a small amount of additional runway. The priority is to get moving immediately.
