As we wrap up for the year, we just wanted to say a heartfelt thank you! Thank you to everyone who entrusted us and a big thank you to those who continued to refer to our principal Charmaine. This was our first official year as CJR Legal and we couldn't be more proud, grateful and thankful. We are so ready for an even bigger year next year with so many goals and aspirations for CJR Legal.

What’s this you say? Well windfall gain tax, is a tax that applies on certain property where the zoning has changed for example from farming to residential and has increased the value of the property by more than $100,000 (taxable value uplift). The tax is:

✖️more than $100,000 but less than $500,000: the tax will apply at a marginal rate of 62.5% on the uplift above $100,000
✖️$500,000 or more: a tax rate of 50% will apply to the total uplift

Having a contract subject to finance means your offer is subject to you obtaining finance to be able to purchase the property and acts as a safeguard in instances where you cannot obtain finance. ʜᴏᴡᴇᴠᴇʀ, if there is a catch when terminating, you must ensure you comply with the general or special condition of the contract of sale. In this instance, the general condition in most contracts states a purchaser can terminate the contract only if:
✖️They immediately applied for the loan; and
✖️did everything reasonably required to obtain approval of the loan; and
✖️serves written notice ending the contract on the vendor within 2 clear business days after the approval date or any later date allowed by the vendor; and
✖️is not in default under any other condition of this contract when the notice is given

Basically you need to of immediately applied for a loan and done everything reasonably required, ensure that the loan amount is also the amount stated in the subject to finance section of the particulars. If your loan has been declined and the amount stated in your decline letter is more than what you stated on the particulars you may not receive your deposit back.

From 9 November 2023 it will be illegal to have unfair contract terms in some instances.
Amendments have been made to the Competition & Consumer Act 2010 (Cth) (CCA) & the Australian Securities & Investment Commission Act (Cth) (ASICAct) and they include:

* the introduction of a civil penalty regime prohibiting the use of, and reliance on, unfair contract terms by businesses;
* expansion of protections to small businesses that are party to a small business contract;
* clarification of factors the courts must consider when determining whether a contract is a standard form contract;
* clarification of court powers to determine an appropriate remedy for breaches of the UCT regime;
* clarification of the contractual provisions that are required, or expressly permitted, under Commonwealth, state or territory laws that are excluded from the UTC regime; and
* new categories of contracts, which are excluded from the operation of the UCT regime.

It applies to all businesses that use standard form contracts in dealings with consumers & small business to:

* supply goods or services,
* sell or lease land, or
* supply financial services or financial products.

Don’t ignore this & start reviewing your contracts as there are penalties for failure to comply.
