What is financial disclosure?

Anyone who is involved in a family law property settlement is required by the Court Rules to be transparent about their finances. This includes their income, expenditure, assets, liabilities and superannuation.

Documentation about all of these issues is generally exchanged between the parties prior to negotiations commencing and commonly includes things like bank account statements, income tax returns, payslips, superannuation statements, loan statements and information about shares or other assets.

The provision of this financial material is essential if parties are to negotiate in the full knowledge of the composition of their property pool. The Court sometimes describes it as ‘laying your cards on the table, face up’. It’s a great description.

What is an intake call and is it really necessary?

I conduct an intake call with each party in every mediation I’m involved in because I find the calls to be a valuable tool to establish rapport, answer any questions people might have and gain a better understanding of the interpersonal issues between the parties.

Before each mediation, I receive paperwork from both lawyers (often referred to as Position Papers) and these help me understand the legal issues that we will be addressing in the mediation. But an intake phone call gives me some personal perspective of both sides and allows me to calm nerves!

You can't get much further apart geographically on mainland Australia than the mediation I conducted last week.

I am in Camden, outside of Sydney, and the parties in this mediation were based in Darwin and in Perth. Huge distances! But we were able to bridge the gap with the wonders of Zoom to enable the parties to reach agreement and get themselves out of the Court system.

It was hugely satisfying.

In addition to my private mediation work, I sit on a panel of 10 senior mediators across Australia who undertake Conciliation Conferences on behalf of the Family Court, assisting people to reach agreement on property issues and end their litigation. In that role, I conduct family law property mediations to parties all over Australia, including the NT, South Australia, Victoria, Queensland and New South Wales.

It's really great helping people resolve their Court proceedings and it's nice when they are satisfied with the process.

Can I bring a support person to the Mediation?

Mediation is generally conducted only with the parties and legal representatives present in the Mediation room, but it may be possible for you to have a support person in your breakout room, regardless of whether your Mediation is being conducted in person or online.

The support person does not enter the main Mediation room but is available to speak to you about the offers that are taking place when you’re present only with the Mediator. We need to obtain the consent of the other party if you would like a support person to attend with you so please do provide us with notice of this. The other party may also ask to bring a support person.

When you’re thinking about someone to bring along, we recommend you choose someone who is level headed, has your best interests at heart and can remain sensible and balanced in their responses to things. When you're feeling emotional and overwhelmed, it’s really helpful to have a steady presence in the room who can give you honest feedback.

How do I prepare for Mediation?

You can improve the quality of your mediation by considering:
• the issues that are in dispute, including the provable facts and the sources of conflict
• what is important to you in resolving your dispute. Be aware that the interests you wish to pursue may be different to an outcome that is sought if you are proceeding to a trial at Court
• how best to communicate this information, both to the mediator and to the other party
• what you might like to say at the start of the mediation to assist in resolving the dispute
• what the other party’s aspirations might be, and how these might be accommodated in any offer of settlement
• possible contents of an offer

It is important to keep in mind what costs have already been incurred and what costs are likely to be incurred in the future if you need to proceed to trial, along with the full range of possible outcomes if you do go to Court.
