From lutruwita/Tasmania to the Kimberley 🖤

Recently, our team member Greg spent five weeks travelling by road from Hobart to the Kimberley with family, taking in an incredible stretch of the country along the way.

The journey took them through South Australia and the Northern Territory before reaching the Kimberley, visiting places including El Questro, Home Valley, King Edward River, Manning Gorge, Dalmanyi (Bell Gorge), Bandilngan (Windjana) Gorge and Dimalurru (Tunnel Creek).

From there, the trip continued through Broome and the Dampier Peninsula before the long journey home across Western Australia, the Nullarbor and back to lutruwita/Tasmania.

For Greg, travelling through remote Australia is nothing new. Having spent significant time across outback Australia and in many remote communities, he says “the red dirt has certainly got into my skin.”

That connection to place and firsthand understanding of the distances, landscapes and communities across regional and remote Australia is something we value at Marrawah Law. Our work regularly takes our team beyond the office and having people who understand the realities of working and travelling across these areas is an important part of how we stay local, connected and accessible to the communities and clients we work with.

Thanks to Greg for sharing a glimpse of his travels and some spectacular parts of Country along the way.

Our work takes us across a vast footprint!

Last month, our staff were on Truwana (Cape Barren Island), lutruwita/Tasmania, one of the many places our team travels to as part of Marrawah Law and Advisory’s work with clients and communities across Australia.

From major cities to regional and remote communities, our work regularly takes us across Country, by road, air and sometimes across the water.

For our Principal Solicitor, Leah Cameron, this particular trip carried an added significance.

Leah’s family left Truwana in the 1920s and while she grew up knowing exactly where she came from and her family’s connection to the Island, she had never had the opportunity to stand there herself.

There is something powerful about the places our work takes us. Sometimes they are new. Sometimes, as Leah described Truwana, you arrive somewhere you feel you have always known.

We are proud to be a First Nations owned national law firm whose work takes us across some extraordinary parts of Australia and grateful to the communities who welcome our staff onto Country along the way.

Thank you to everyone on Truwana who made room for us.

Celebrating Excellence in Law 💫

Marrawah Law and Advisory is proud to sponsor the Milirrpum Prize for Indigenous Excellence in Law at the Charles Darwin University School of Law Prize Giving Ceremony.

We are delighted to congratulate the 2025 recipients, Djamarlia Nevina Tanaqua Darr-Lade and Stephen John Harrington, on this well deserved recognition.

Djamarlia, a Juru and Pacific Islander woman, developed her interest in law while growing up on Yolngu Country and is passionate about using the law to advance the interests of First Nations people. As she approaches the end of her degree, she hopes to continue the legacy of those who came before her and uplift other First Nations people in the legal profession.

Stephen completed his Bachelor of Laws while working full time and supporting his young family. Having lived and worked across Arnhem Land, the Tiwi Islands, Wadeye and Katherine, he is particularly interested in improving access to justice and addressing legal issues affecting remote communities.

While our team was unable to attend this year’s ceremony, we are incredibly proud to support an award that recognises excellence in legal education and celebrates people committed to making a meaningful contribution through the law.

Congratulations Djamarlia and Stephen, we look forward to seeing where your legal careers take you.

🖤💛❤️ Celebrating two years of the Palawa Business Hub

Marrawah Law is proud to celebrate two years of the Palawa Business Hub and the important work it continues to do supporting Aboriginal businesses across lutruwita/Tasmania.

In just two years, the Hub has achieved some incredible milestones:

- Built a directory of more than 50 majority Aboriginal owned Tasmanian businesses, spanning the arts, tourism, trades, professional services and more.

- Delivered its first Palawa Business Showcase, bringing together close to 20 businesses and around 250 people.

- Advocated for stronger Indigenous procurement, contributing to a procurement framework review being included in the Tasmanian Government’s Closing the Gap Implementation Plan 2025-2028.

- Secured four years of State Government funding to continue building on this important work.

But the impact of the Hub goes well beyond the numbers. It is creating a place where Aboriginal entrepreneurs can bring an idea, find support and connections and build the confidence and tools to turn that idea into something sustainable.

For Marrawah Law, supporting strong Aboriginal businesses is part of a much bigger picture. Economic self determination means creating jobs for our mob, building intergenerational opportunity, keeping wealth within our communities and empowering Aboriginal people to determine their own futures.

Congratulations to Sara Maynard, Leah Cameron and the Palawa Business Hub team and all of the businesses that have been part of the Hub’s journey so far.

Two years down, with plenty more still to come. 🖤💛❤️

Marrawah Law and Advisory congratulates the Wadja People on the Federal Court’s recognition of their native title rights and interests through a consent determination made on 18 August 2026.

This is a significant milestone for the Wadja People, recognising their enduring connection to Country and providing formal legal recognition of their native title rights and interests.

Consent determinations are particularly significant because they are achieved through agreement rather than a contested trial. They reflect the considerable work, negotiation and commitment of Traditional Owners and the other parties involved in reaching an agreed outcome.

Marrawah Law and Advisory was pleased to act for one of the local government respondents in the proceeding and to have played a part in supporting the parties towards this outcome.

We extend our congratulations to the Wadja People, their Elders, families and community and acknowledge the many years of work that have contributed to reaching this important day.

We wish the Wadja People every success as they move forward with the recognition and protection of their native title rights and interests for current and future generations.

Congratulations to the Wadja People on this significant achievement.

A proud milestone for the Marrawah Law and Advisory team.

Last week, we had the privilege of celebrating the admission of two outstanding women to the legal profession in the same sitting of the Supreme Court.

Congratulations to Tyenna Hogan, a proud Palawa woman whose commitment to advocating for community and amplifying the voices of others will undoubtedly make a lasting impact on the profession.

Congratulations also to Olivia Bellchambers, who has been a valued member of the Marrawah team as a paralegal. Watching Olivia's journey from paralegal to admitted lawyer has been incredibly rewarding.

We couldn't be prouder of everything these ladies have achieved through their dedication and hard work.

These milestones are a reminder of the importance of supporting and investing in the next generation of lawyers. We are proud to celebrate both Tyenna and Olivia as they begin this exciting new chapter in their legal careers.

Congratulations to you both, the future of the profession is brighter with you in it.

A significant High Court decision for native title, water law and administrative law.

Today, the High Court of Australia delivered its judgment in Mpwerempwer Aboriginal Corporation RNTBC v Jemninaal Pty Ltd & Ors, allowing an appeal by the native title holders and reinforcing important principles of lawful decision making.

While the case concerns a groundwater extraction licence in the Northern Territory, its significance extends much further. The judgment provides guidance on the limits of statutory decision making powers, particularly where substantial changes are made to an application that may affect the rights and interests of Traditional Owners.

The High Court confirmed that a decision maker cannot rely on a power to "vary" an application where the changes are so significant that they effectively create a new application.

This principle is likely to be closely considered in future decisions involving environmental approvals, infrastructure, resource projects and other statutory regimes affecting First Nations rights and interests.

Marrawah Law would like to congratulate the Central Land Council, the Traditional Owners and the legal team involved in achieving this important outcome.

Swipe through for a summary of the decision and why it matters.

For many years, there was little judicial consideration of Western Australia's "passthrough" provision in s 125A of the Mining Act 1978 (WA).

A recent Federal Court decision has now confirmed that the provision validly allocates liability for native title compensation to the applicant for or holder of a mining tenement.

Native title compensation is an evolving area of law with significant implications for Traditional Owners, proponents, government and industry.

In our latest article, we explore:

• How the passthrough provision works
• The constitutional challenge to s 125A
• How liability is allocated in other jurisdictions
• What the decision means in practice
