'What happens if my finance falls through after I've signed the contract?' 🤔❓

It's one of the scariest questions in property - but the good news is, if you've got the right conditions in place, you're protected.

Here's how it works in Queensland:
If your contract includes a finance condition (and it should), you have a set number of days to obtain formal finance approval. If you genuinely can't get finance within that period, you can terminate the contract and get your deposit back - no penalty!

⚠️ NOTE: the key word there is 'genuinely'.
You can't simply change your mind and use 'finance' as a reason to exit. The condition requires a genuine attempt to obtain finance and a legitimate reason for the decline.

What to do if finance is looking shaky:
💰 Contact your broker immediately - don't wait until the deadline
💰 Let your conveyancer know so they can assess your options
💰 Ask about a finance extension - the seller may agree to give you more time
💰 Understand your position before the deadline passes, not after

Getting caught off guard by a finance deadline is one of the most stressful situations in a property transaction. At Impact Legal we track these dates for you and flag them well in advance.
