The Supreme Court has recently ordered a Queensland couple to sell their home for $145k less than they intended to sell it for. An expensive mistake in the contract has led to a Court order for specific performance in favour of the buyers.

Don’t gamble with important financial decisions. Have the sales agent send the contract through to us to check it before you sign.

A recent decision by the Queensland Supreme Court this year is a cautionary tale of why it’s important to see a lawyer when making your Will, instead of attempting to save money by doing it yourself, or in this case having your accountant do it.

“Mr and Mrs Di Trapani were people who took their finances seriously and were clearly careful when it came to spending money. In pursuance of their fiscal prudence, they sought to save money when updating their wills in November of 2010, by using an accountant to draft the new wills.”

After their death, “disputes arose as to certain aspects of the will, and the executors sought declarations from the court in relation to its interpretation.

The proceedings were relatively complex, involving multiple law firms and counsel – ironically, the desire of Mr and Mrs Di Trapani to avoid expensive disputes by engaging a non-lawyer to draft their wills has led to the involvement of many more lawyers, and no doubt a great deal of expense.

Mr and Mrs Di Trapani will never know the expense and angst caused by their well-meant attempt to save money, but their children certainly do.”

There was no evidence that either of them received any legal advice prior to executing the new wills.

A recent heartbreaking reminder of why everyone should have a Will, even a 24 year old tradie. This dispute could have been avoided if this young man had made a Will. Instead legal fees in this inance funded by the parents would have been very costly.

In the aftermath of the tragedy, a deeply personal dispute has erupted between Kaleb’s parents over how the young tradie should be laid to rest.

Kaleb died without leaving a will — and court documents reveal that the dispute quickly got ugly.

The Supreme Court of WA was told that the pair were locked in a heated disagreement over who should organise the funeral, which funeral home should handle the service and who should control Kaleb’s ashes.

The situation escalated after Kaleb’s father Kane Brunsdon found out that his late son’s mother Lauren Suarez had already started organising the funeral.
