🏡 Thinking of buying a property? Don't forget the cooling-off period.

Many residential property contracts in Queensland include a cooling-off period, giving buyers a short opportunity to reconsider their purchase.

The cooling-off period lasts for 5 business days from the day the buyer receives a signed copy of the contract.

During this period, a buyer may be able to terminate the contract for any reason.

However, there are some important things to know:
• A termination penalty may apply (0.25% of the Purchase Price)
• Not every property contract includes a cooling-off period. For example, Commercial Contracts do not contain a cooling-off period.
• Strict requirements apply when terminating a contract

Many buyers mistakenly believe a cooling-off period provides unlimited protection. In reality, it is only one part of the buying process.
Obtaining legal advice before signing a contract can help you fully understand your rights and obligations.

⚖️ What is a Family Provision Claim and who can make one?

Many people believe that having a Will means their wishes will always be carried out exactly as written. However, under Queensland law, certain people may be able to challenge a Will if they believe they have not been adequately provided for.
This is known as a Family Provision Claim.

A Family Provision Claim allows an eligible person to ask the Court for a greater share of an estate if they can demonstrate that adequate provision has not been made for their proper maintenance and support.

Who can make a claim?
In Queensland, eligible applicants generally include:
• A spouse (including a de facto partner)
• A child of the deceased (including adopted children)
• A dependant of the deceased

Making a claim is not automatic. The Court will consider a range of factors, including:
• The size of the estate
• The applicant's financial circumstances
• The applicant's relationship with the deceased
• The needs of other beneficiaries

Family Provision Claims have strict timeframes, so it is important to seek legal advice as soon as possible if you believe you may have a claim.

Being an Executor – What It Really Involves

Being named as an executor in a Will carries significant responsibility. The role of an executor is to administer an estate according to the Will and the deceased's wishes.

An executor’s duties in Queensland can include:
· Locating and managing assets
· Applying for a Grant of Probate
· Paying debts and liabilities of the estate
· Managing tax obligations
· Distributing the estate according to the Will
· Acting in the best interests of beneficiaries

Executors can also be personally liable if mistakes are made or duties are not carried out correctly.

Common challenges for executors include:
· Complex estates which may involve significant assets, overseas assets or multiple beneficiaries
