During your property mediation, our Family Dispute Resolution Practitioners will work with you using the Family Law legislation to consider factors which affect the property division and assist you to arrive at a just and equitable property pool split.

Our mediators do not give legal or financial advice, however they can assist you to negotiate a fair split which considers all of the factors relevant to your individual circumstances.

What is a property pool?

Assets, liabilities and superannuation held by both parties to the marriage as well as those held in either party's name.

Splitting your property pool can be complex, depending on the amount and type of assets that you and your ex-partner hold.

During the intake sessions, prior to mediation, we will explain the process of splitting a property pool and the various options available to you. You may be asked to value some assets, or to provide documents regarding some assets and their value.

We understand your perspective before mediation. Our service includes thorough intakes with each party.

An intake session is an important pre-mediation step, which is included in our fixed fee pricing structure.

The confidential one-on-one session is held with each party and can take up to 1.5 hours.

The purpose of the intake session is to:
• Screen the matter for suitability;
• Gather information about your circumstances;
• Explain the process of mediation;
• Assist you to prepare for mediation; and
• Tailor the provision of our service.

Mediation day can be emotionally and physically demanding for all parties. Having a thorough intake session prior to the day can allow your perspective to be heard in a calm environment and allow the mediator to request further information, if necessary, prior to the mediation day, and assist you to achieve positive outcomes.

Clark & Associates has several experienced panel mediators. Today we highlight Ms Julia Boyd.

A natural mediator, Julia joined the Clark & Associates team in 2019 as a trainee mediator and became accredited in 2020.

Julia has extensive experience in commercial law having worked in both global and regional law firms since her admission to the Supreme Court of Queensland. She holds a Bachelor of Laws (Honours) and Bachelor of Science. She has a broad range of experience including property development, leasing, management rights and body corporate issues, general property matters, sales and acquisitions, business transactions, franchising, as well as neighbourhood disputes.

Her experience ranges from acting for publicly listed companies to smaller business operators and individuals on a broad spectrum of issues including commercial, title and neighbourhood disputes.

Julia is passionate about helping people resolve disputes respectfully in a cost effective manner.

Julia is available for commercial, neighbourhood and franchising mediations in 2023.

Clark & Associates has several experienced panel mediators. Today we highlight Ms Linda Kochanski, one of our panel mediators since 2019.

Linda holds a Bachelor of Laws, Graduate Diploma in Legal Practice and a Graduate Certificate in Education (Higher). She is a Nationally Accredited Mediator and an Accredited Family Dispute Resolution Practitioner.

Linda started her professional life as a lawyer specialising in Family and Criminal law. In the early 1990s Linda trained at Relationships Australia Queensland as a mediator and worked for Relationships Australia in several positions until she moved into private practice.

In 2016 Linda was elected as Director of the Mediation Standards Board. In 2018 Linda was Family Dispute Resolution Practitioner of the Year and Alternative Dispute Resolution Academic of the Year in the Australian Dispute Resolution Awards.

Linda has trained mediators since 1996, working for Griffith University, QUT and Bond as a lecturer and co-ordinator of courses. Linda has held the position of Co-Director of the Bond Dispute Resolution Centre from 2012 – 2015 and is presently Practice Leader: Dispute Resolution Programs, College of Law (Australia).

Linda has published articles and presents regularly nationally and internationally on dispute resolution and, in particular, family mediation.

Linda is available for family dispute resolution in 2023.

At Clark & Associates we have several experienced panel mediators. We are pleased to highlight Ms Sophie Jordan.

Sophie Jordan is a Clinical Psychologist, Family Report Writer, a Nationally Accredited Mediator, an Accredited Family Dispute Resolution Practitioner (FDRP) and Triple P provider. She holds a Master of Psychology (Clinical) and Postgraduate Diploma of Professional Psychology. She has a lengthy background in family separation work.

Sophie can assist as a child expert in child-inclusive mediations, or as a family dispute resolution practitioner, assisting families resolve parenting issues.

Sophie is available for family dispute resolution and child-inclusive mediations in 2023.
