F is for Facts.

It is what it is. Facts don’t change, but how you present them does.

Your case strategy should focus on taking what you have by way of facts and evidence and putting your best case forward in court. The best way to do that is give the court something easily digestible, believable, backed by written evidence.

Picture this:
- Person 1: Hey that’s my image, I didn’t say you could use it, stop please.
- Person 2: What are your talking about, I took that image myself.

Who will be believed? The one that can provide the original image, with dates the image was taken and also provides the other very similar images they took at the same time. In some cases, that’s Person 2!

Facts of a case are never perfect—but you can make the most of what you have in evidence and put forward your strongest possible case. Sometimes, you don’t need perfection, just the right perspective and great lawyers (see G for Great Lawyers).

Tip:

There’s an old saying, 'You can’t make a silk purse out of a pig’s ear.' Perhaps the facts of your case are a pig’s ear and you desperately want to turn it into a lovely silk purse for the court because you think that is what is what is needed for success. But sometimes, that pig’s ear is the real treasure— perspective is everything. And if you don’t believe me, ask my doggo. She’ll take the pig’s ear every time… and maybe my hand with it!

E is for Enforcment.

This one might confuse you, but hear me out. Enforcing your rights is a defensive move, not an aggressive move.

Picture this:

- You're happily going about your business and discover a stranger is using your name in business, and worse, they sell the same things as you.
- You’re losing sales and strangers are demanding full refunds on sales you didn’t make.
- After much hair pulling you call the other trader to point out the issue thinking its all a big misunderstanding and ask them to stop but ... ahem… they not-so-politely tell you no.

Who is the aggressor in this scenario? You need to protect yourself and your business. Just like you would your home as though someone came in and kicked down the door.

When someone breaches a contract or infringes your intellectual property, enforcement is how you fight back. It doesn’t mean you have to end up in court and enforcement isn’t about picking you picking the fight—all you are doing is returning a punch.

You need to protect your business interests against those who cross the line. Because if you are even moderately successful, someone will cross the line. There’s always someone testing boundaries and riding on the coat tails of others.

Start with solid trade mark, copyright and other IP protections. Have good solid contracts which are future proofed and protect your interests. Be ready to enforce your rights as soon as they are breached.

And when push comes to shove, sometimes you’ve got to throw the rule book at them by going to Court ... figuratively, of course (well, mostly).

TIP:
Just like you insure your home against break-ins, you can protect your business and intellectual property the same way. Talk to your insurance agent about cyber, IP, and even ‘after-the-fact’ insurance.

If you have a .au domain name and recently bought a business or transitioned from being a sole trader to a company, this is a heads up!

If you originally registered your domain name under your sole trader business and later transitioned to a company structure, did you update your domain name license details? Or, what if you bought a business with a .au domain name—did you update it then?

auDA - .au Domain Administration Ltd. sets the rules for .au domain names, and under their policies, you could lose your domain name if it’s controlled by a non-related entity. When you go from a sole trader to a company or buy a business where the domain is still in the old name, these entities are potentially unrelated.

So if you’ve forgotten or neglected to transfer the domain name to the right entity and have carried on without updating it, you risk losing the domain altogether for breaching auDA rules.

In a worst-case scenario, a competitor could reserve your old domain, gain access to incoming emails intended for you, and potentially run a competing business under your domain name.

It’s a simple but critical update that can protect your business operations.
To check your .au domain name license details, do a WHOIS search here: https://whois.auda.org.au/

Look for the word “Registrant”—that’s the name of who holds the domain (it’s right at the bottom). Admin and technical contact details are not ownership details.

To transfer the domain name, contact your domain administrator (e.g., GoDaddy, CrazyDomains, etc.).

And if a competitor has taken over your old domain, give us a call. We love domain name and IP theft disputes and are pretty good at them.

ProTip: Don’t just update the admin and technical contact details of the domain name. You need to transfer the domain so it sits in the name of the correct entity—this usually incurs a fee, and simply updating details won’t suffice.
