Preparing a Family visa? Do you know what evidence you may need before you start?

Family visas can involve much more than proving that you are related.

Depending on the visa category, applicants and sponsors may need to consider relationship evidence, identity documents, financial or dependency information, health and character requirements, sponsorship eligibility and previous immigration history.

The exact requirements differ between Partner, Parent, Child and Other Family pathways.

Good preparation begins with knowing which visa actually fits the family circumstances.

Speak with NB Migration Law before lodging.

Waiting for your Australian Permanent Residency invitation?
If you have submitted an Expression of Interest (EOI) through SkillSelect, this is an important update for you.

Visa refused? What you do next may depend on what the decision letter actually says.

A refusal does not automatically mean every applicant has the same review option.

Depending on the decision and circumstances, there may be rights to seek review through the Administrative Review Tribunal, while some matters may involve judicial review through the courts.

These are different processes with different legal questions, requirements and time limits.

Before acting, understand exactly what review rights you have.

Thinking about a subclass 407 Training visa? Is the proposed training genuinely structured around your development?

The Training visa is not simply another way to employ someone in Australia.
Subclass 407 covers specific occupational training purposes, and the requirements differ depending on which training category applies.

A strong application needs to demonstrate why the training is required, how it is structured and how it relates to the trainee's circumstances.

Before preparing the nomination, make sure the training itself fits the visa.

Your employer wants to sponsor you. Where do you actually start?

Employer sponsorship is not simply a matter of an employer offering you a job.

The business, position, occupation, salary, employee and proposed visa pathway may all need to satisfy specific requirements.

Depending on the circumstances, pathways may involve the Skills in Demand subclass 482, Employer Nomination Scheme subclass 186 or regional subclass 494.

Where standard programs do not address a genuine workforce need, a Labour Agreement may sometimes be relevant.

Before the employer and employee invest time and money, understand the pathway first.

Graduating soon? What happens to your visa after university?

Finishing your Australian qualification is an achievement, but it is also an important time to review your migration position.

The Temporary Graduate subclass 485 visa has specific requirements around qualifications, age, Australian study and timing. Depending on your circumstances, other skilled or employer-sponsored options may also be worth exploring.

Do not wait until your current visa is close to expiry before thinking about what comes next.

Your graduation date should be part of your migration planning.

Talk to NB Migration Law about your options after study.
