We were proud to support May Day celebrations across Queensland and Tasmania last week.

Last Friday, we joined the May Day Toast in Tasmania, hosted by Unions Tasmania, to recognise International Workers’ Day and celebrate the ongoing contributions of unions in building safer, fairer workplaces and communities.

And on Monday, our Brisbane team took part in Queensland’s largest Labour Day march, hosted by the Queensland Unions. We also had a stall on the day and were proud to stand alongside workers, unions, and community members celebrating hard-won workplace rights.

This day is an important reminder of the power of collective action and the role unions continue to play in advocating for safer and more equitable working lives.

A QCAT decision is a reminder that private conduct can still breach professional standards.

“Professional misconduct” means a serious departure from what’s expected of a registered practitioner.

In this case, criminal convictions outside work led to a misconduct finding and a reprimand. The nurse’s separate failure to notify Ahpra of the charges was treated as “unprofessional conduct” (less serious) due to difficult personal circumstances.

If you’re unsure about your notification duties, get advice early to protect your position.

Tasmanian workers facing termination of worker’s compensation weekly payments on the basis that they have “wholly and substantially recovered” from their work-related injury or illness have significant rights under the law.

Importantly, however, strict time limits apply.

This blog explores your options if your Tasmanian worker’s comp claim is terminated due to whole or partial recovery.

On occasion, a worker may be asked to sign a deed of release when an employer moves to terminate the worker. A deed of release is a legally binding document between an employer and employee, setting out the terms of settlement (for example, payments and what each party can and cannot do) following an employee’s termination.

This article explores how a deed of release can affect an injured worker’s ongoing worker’s compensation benefits following termination of employment.

Age discrimination is prohibited in Australian workplaces.

The law recognises “direct” discrimination (being treated less favourably because of age) and “indirect” discrimination (an unreasonable rule or practice that disadvantages your age group).

In this article, we review the case of Gutierrez v MUR Shipping [2023] FCA 399, where the Federal Court found age discrimination and ordered just over $232,000 in damages.

If age discrimination is happening to you, you can complain in writing to the Australian Human Rights Commission. Clear remedies exist, including compensation and orders to stop the conduct.

In this article, we focus on one particular kind of restraint, the “non-compete” covenant.

A non-compete covenant is an obligation contained within a contract of employment that expresses itself as preventing an employee from working for one or more alternative employers or a certain class of them or establishing a competing business of their own.

Our article looks at:
🡆 determining the validity of a non-compete covenant;
🡆 what’s considered a “legitimate interest” of the employer;
🡆 what’s considered a “reasonable” non-compete covenant;
🡆 enforceability of a non-compete clause;
🡆 and more.
