4 tips to assist you in managing your employees' expectations and creating the best outcome for all parties.

1️⃣ Establish a mutually beneficial relationship
Employees have their own expectations of the job, so considering them is the best way to create a mutually beneficial relationship.

2️⃣ Create authentic accountability
Creating authentic accountability involves asking specific questions about the project and how the employee is progressing when completing the tasks at hand.

3️⃣ Quarterly performance reviews
Quarterly performance reviews are encouraged as they allow SMART goals to be set every 3 months and offer a moment for reflection for both employer and employee.

4️⃣ Remind employees of their expectations
Ask employees to repeat their expectations once they have been agreed upon to ensure there is no confusion between the two parties.

We know what you're thinking, $355,000 in penalties is a lot for a business in the current climate! Keep reading to find out why...

The operators of a Brisbane sushi restaurant have been fined after they deliberately underpaid employees and falsified records. This penalty stands as the second highest Fair Work Ombudsman has ever seen.

This penalty comes as a result of Delishesco deliberately underpaying 34 employees for a total of $75,716 between December 2018 and March 2019. After receiving a warning, they knowingly provided the FWO with
records during an investigation.

NEWS: Queensland fence construction company penalised

💼 The Fair Work Ombudsman has secured a total of $14,200 in penalties in court against the operators of a fence construction business in Goondiwindi.

Preparing your business for potential workplace audits is the best investment you can make as we enter the new financial year. If you don't know how to do undertake a workplace audit, here's a good way to start!

1. Get an External Review
An external auditor can conduct a thorough review of all existing workplace policies and procedures, employee records (including employment contracts/agreements) and applicable Awards to ensure you are legally compliant.

2. Identify Areas of Risk
Under the review, the specific areas of risk will be identified and you will receive advice to address/rectify the issues by priority.

3. Draft New Policy and Procedure Documents
Once the areas of concern are identified, new policies and procedures and employment contracts/agreements for your company can be created in compliance with the appropriate legislation.

4. Implement a Crisis and Risk Management System
A Crisis Management Plan is a risk-averse way to incorporate new policies into your business, ensure that you're keeping on top of industry changes, and are prepared for potential crisis situations.

The Optimum Legal team is equipped with expertise and knowledge to assist you with an external workplace audit. Enquire via our website.

⚠️ Jenny Global Pty Ltd, previous operators of the Dae Bark Mart Asian grocery store in Melbourne, have received a penalty of $108,00 for underpaying a migrant worker. ⚠️

The court revealed that a South Korean migrant, who held a working holiday visa, was only paid $12 to $16 per hour while employed as a retail assistant between Jan and May 2020. Additionally, the company failed to provide payslips to the staff member.

Fair Work Ombudsman, Sandra Parker, warned employers saying, "Employers should be in no doubt that we prioritise the protection of vulnerable workers, including migrant workers who we know can be at particular risk of exploitation.” This case is a reminder to all employers of the importance of paying all workers fair wages, regardless of their nationality or visa status.

As an employer, it is important you put measures and policies in place to minimise the risk of sexual harassment occurring in your workplace.

Employers may be vicariously liable if one of their employees commits sexual harassment and the employer did not take all reasonable steps to prevent the employee from carrying out these acts.

The first step is understanding what workplace sexual harassment looks like. Sexual harassment is unwanted or unwelcome sexual behaviour that makes a person feel offended, humiliated or intimidated.

Here are some steps you can take to protect your business and employees:

1. Provide workplace training to all staff
2. Have a formal procedure that addresses and resolves complaints
2. Educate yourself on the legalities of sexual harassment claims in the workplace

Optimum Legal can ensure you have robust policies in place and help you to communicate this with your staff, as well as to conduct regular professional workplace training on all areas of workplace disputes that can lead to legal claims.

Another EOFY, another super guarantee increase! Get ready for changes after July 1. We're here to tell you what you need to know:

1. Super Guarantee Increase - the Australia Tax Office has announced an increase in the SG from 10% to 10.5%.

2. Super Eligibility - there are changes to who is eligible for super. According to the ATO, "the $450 per month eligibility threshold for when SG is paid is being removed. You only need to pay super for workers under 18 when they work more than 30 hours in a week."

Ensure that you have communicated the changes to your payroll team and accounting systems so that your business is correctly paying super for your employees.

Have you heard the latest news? Fair Work Commission has announced that the minimum wage is set to increase 5.2 per cent by July 1 2022.

What does this look like? Low-income earners can expect to earn a minimum of $812.60 per week, or $21.38 per hour, before tax. This decision was in response to the rising cost of living and Australia's low-earning workers struggling to cover living expenses.

How can you prepare as a business?
👉 Manage employee overtime & hours
👉 Revise your payroll budget & plan for the increase in overheads
👉 Review salary benchmarks & policies
👉 Manage employee expectations
