Can You Get Paid to Donate Eggs in Australia?

The short answer is no. Only altruistic egg donation is allowed in Australia, and paying or being paid to donate can be a criminal offence. Reasonable expenses can be covered, though. If you’ve frozen your eggs and later decide to donate the ones you no longer need, you may be able to recover the costs of collecting, storing and transporting those eggs. Some clinics say it can’t be done, but Stephen Page explains why, in his view, there is a lawful way to do it.

High Court: Prisoners Can Apply to Freeze Their Eggs

A Queensland prisoner first asked to freeze her eggs at 32. By the time the High Court decided her case, she was 35, and she’ll be around 39 or 40 when her sentence ends. Queensland authorities said egg freezing was “assisted reproductive technology,” which prisoners can’t access, and the lower courts agreed. The High Court unanimously disagreed. Egg freezing preserves fertility; it doesn’t create a pregnancy. The Court also firmly rejected the idea that losing your fertility in prison is part of the punishment. The Australian Law Reform Commission's surrogacy report has been delivered to the Commonwealth Attorney-General, with 18 November identified as the tabling deadline. The ALRC can recommend reform but cannot rewrite the law itself, and surrogacy rules remain a patchwork across states and territories. A decade ago, a parliamentary inquiry recommended national laws that Australia still does not have.

🚨 Australian Surrogacy Law Change: Nearly 3,000 Children's Legal Parentage Could Be at Risk

A significant change to Australian family law could have serious consequences for families who have welcomed children through international surrogacy.

In this episode of the Australian Family and Fertility Law Podcast, Stephen Page of Page Provan Family and Fertility Lawyers discusses the repeal of Regulation 10.3 of the Family Law Regulations 2024, due to take effect on 9 December 2026.

This change will remove important legal presumptions that currently help recognise the parentage of children born through overseas surrogacy arrangements.
