🚨 Judge Blocks Trump's Birthright Citizenship Order — What It Means for Surrogacy Families

Today (2 September in the US), a judge has blocked the Trump administration from enforcing the birthright citizenship order that prevents children being born via surrogacy there to foreigners from obtaining a US passport. Judge Boardman in Greenbelt, Maryland, has issued the injunction. Round one to the opponents of this birthright citizenship order.

For now at least, children born through surrogacy in the US to foreign intended parents will be entitled to a US passport, as they always have been. Today's victory is a victory for the rule of law.

It will only be a question of time before the Trump administration appeals. Given the history of the last birthright citizenship order, it is inevitable that this dispute will end up with the Supreme Court.

Surrogacy in Sri Lanka is available to Australians — but only if you're of Sri Lankan origin and part of a heterosexual married couple.

Stephen Page explains that Sri Lanka is an overlooked surrogacy destination, offering low-cost IVF, legal advice, and relatively quick matching with surrogates, largely due to the country's weakened currency following its economic crisis.

Parentage recognition has changed significantly. Sri Lanka previously recognised parentage through adoption — but adoption creates real legal risk for Australians, since every Australian state and territory criminalises paying for a child's adoption overseas, with no distinction between standard adoption and surrogacy-related adoption.

The modern approach is different: intended parents are named directly on the Sri Lankan birth certificate through the hospital, avoiding adoption altogether. Since changes to Australian family law last year, being named on the birth certificate in a recognised country like Sri Lanka creates a presumption of parentage under the Family Law Act.

In practice, though, the Department of Home Affairs often still requires an Australian DNA test before granting citizenship — even when parentage is presumed under the law.

Getting this wrong can mean serious criminal penalties for overseas commercial surrogacy or egg donation offences. Legal advice before you start is essential.
