NEWS: In a weekend article by The Sydney Morning Herald and The Age about the challenges faced by injured workers, our Principal, Kate Denning offered insight into the seemingly intrusive nature of WorkCover investigations.

After a serious bike crash, Greg’s experience making a WorkCover claim left him feeling exposed and frustrated. A private investigator called, asking about everything from his stress levels to his relationship, even though his claim didn’t meet the scheme’s criteria.

In the article, Denning Insurance Law Principal, Kate Denning, explains:

“Insurers often ask detailed personal questions to assess whether a person qualifies as a ‘worker’ under the legislation, especially for journey claims. But if you’re worried about how your data will be used, or what happens if your claim is rejected, you should speak with a lawyer first.”

Too often, people don’t realise how much personal information they’re handing over, or that it might be held for years. If you’re thinking of lodging a claim and don’t know where to start, we’re here to guide you through it - confidentially, clearly, and with your best interests at heart.

Thank you Australasian Lawyer!

Denning Insurance Law has been named one of the Top Specialist Firms in Australasia and New Zealand for 2025.

And while we’re not in it for the accolades — we are genuinely grateful for this recognition.

From day one, our position has been clear:

We don’t act for insurers. We act only for people and businesses.

That’s not the norm in our field. In fact, we often hear from colleagues and clients:
"I don’t know anyone else who does what you do."

And they’re right. Most firms in insurance law represent insurers. We chose a different path. And because of that, how we work is different too.

There’s no cookie-cutter model. No KPI to turn around an advice on indemnity, liability or quantum in X days. No template for real-life, human and commercial problems. This makes our work niche and often means that we are fighting battles on multiple fronts.

Whether our client is seeking compensation or navigating an insurance dispute, the core principle remains: deliver specialist legal services with care and clarity.

We are a small firm! But the depth of knowledge and experience of our people is what allows us to consistently deliver high-quality representation in a space that often overlooks the individual.

That’s what helped us stand out in a rigorous five-month review by Australasian and NZ Lawyer, supported by insights from more than 30 industry experts.

Thank you to our clients for trusting us.

This month marks 10 years in business for Denning Insurance Law!

In 2015, I launched Denning Insurance Law after 13 years in the industry—armed with experience, a strong values framework, and three kids under 9.

I didn’t want to build just another law firm. I wanted to create a firm that provided big firm knowledge, with small firm service — one built on:
• Transparency
• Reasonableness
• Results

By 2018, I was recognised as an Accredited Specialist in Personal Injury Law—the only sole practitioner to receive it that year.

What followed has been a decade of staying true to our purpose:

For people and businesses, never insurers.

We’ve helped hundreds of clients face insurers with confidence, and built a reputation based on trust, not volume.

I’m so proud of the clients and team that I’ve worked with over the years, which have helped us carve out our niche in the market. And a huge thanks to our network of friends, family and professionals, who have referred us work.

Here’s to the next 10!

🚨 Legal Update: In the recent workers' compensation case of Gairns v Pro Music Pty Ltd case, an internal sales supervisor was awarded over $300,000 after a poorly handled demotion led to severe psychiatric injuries.

This ruling by the District Court of Queensland highlights the importance of fair treatment and proper procedure in the workplace

In this case the employer:
❌ convened a meeting with the worker in an open plan office, in the presence of 2 co-workers
❌ told the worker he would be demoted after the weekend and that his salary would be reduced
❌ gave the worker no prior notice of the meeting
❌ knew that the worker was an emotionally vulnerable person
❌ failed to raise any previous performance issues with the worker in a formalised way, prior to the meeting
❌ appointed a new employee to the worker's role, rendering his position unnecessary

The Court found that the employer's conduct would have been distressing to any employee.

This case highlights the crucial need for employers to follow proper procedures and consider the mental well-being of their staff.

🚨 Important Legal Update: $283k Award in Hornsby Shire Council v Salman 🚨

We're diving into a Court of Appeal case that highlights the responsibilities of local councils in maintaining safe playgrounds. In Hornsby Shire Council v Salman [2024] NSWCA 155, the NSW Court of Appeal upheld a $283,200 award for Ms. Salman, who was injured due to a trip hazard in a public playground.

This decision demonstrates the importance of addressing even minor hazards in public spaces. The Court found the Council negligent for not levelling the surface between mulch and wet-pour rubber, despite prior warnings from safety experts.

Key takeaways:

* Regular inspections and timely responses to safety reports are essential.
* Ignoring expert advice can lead to significant legal consequences.

This ruling sets new standards for playground safety and public liability.
