A topical reminder of the importance of binding death benefit nominations for superannuation. Following the tragic death of Ashleigh Petrie, her superannuation fund has paid her death benefit to her partner. Ashleigh had previously expressed her wish that it be paid to her mother. If a binding death benefit nomination is not in place, a superannuation fund is bound by law to pay any death benefit first to a death benefits dependant. This includes a person who was in an interdependency relationship with the deceased at the time of their death. While it isn't clear from the article, we suspect this was the case with Ashleigh's partner. As a result the superannuation fund is bound to pay it to him rather than Ashleigh's mother, who we suspect, was not a death benefits dependant. To find our more, please get in touch.
