Supporting Australian business to fill critical skills needs

A new priority skills list and strengthened labour market testing will allow small numbers of sponsored skilled workers to return to Australia to fill urgent skills needs in critical sectors, helping to create Australian jobs and rebuild Australia’s economy.

The 17 occupations on the Priority Migration Skilled Occupation List (PMSOL) were based on advice from the National Skills Commission and consultation with relevant Commonwealth
agencies and will be reviewed regularly.

Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge said the changes would strike the right balance for Australia’s economic recovery.

“Our priority is getting Australians back into work but we also need key health workers to help fight the virus and skilled migrants who are going to be job multipliers, to help the economy recover,” Mr Tudge said.

“These occupations in the health care, construction and IT sectors will supercharge both our health and economic response to COVID-19. “Visa holders, who have been sponsored by an Australia business in a PMSOL occupation can request an exemption from Australia’s travel restrictions, but will be subject to a strict 14 days
quarantine on arrival at their own expense.”

Minister for Employment, Skills, Small and Family Business, Senator the Hon Michaelia Cash said the PMSOL would be complemented by strengthened labour market testing requirements.

“In addition to the current requirements of two national advertisements, employers must also advertise their vacancy on the Government’s jobactive wesbite,” Minister Cash said.

“JobKeeper is keeping many Australians in work and our $1 billion JobTrainer fund will create 340,700 new training places, but some sectors still need more skilled workers now.

“The occupations were chosen after careful analysis of recent changes to the internet vacancy index, changes in employment, and longer-term stability in the labour market for individual
occupations.”

“As COVID-19 continues to play out both at home and abroad, we will closely monitor labour market trends and respond to any changes in our skills needs.”

Existing skilled migration occupation lists will remain active and visas will still be processed, but priority will be given to those in occupations on the PMSOL.

MIGRATION NEWS AND UPDATE

New Regional Visas

The new skilled regional provisional visas will be for skilled migrants, and dependent family members, who want to live and work in Australia.

There will be two new skilled regional provisional visas introduced in November 2019:

Skilled Employer Sponsored Regional (Provisional) visa: for people sponsored by an employer in regional Australia.
Skilled Work Regional (Provisional) visa: for people who are nominated by a State or Territory government or sponsored by an eligible family member to live and work in regional Australia.

Holders of the new skilled regional provisional visas will need to live and work in regional Australia. Visas will be granted with a validity period of up to five years.

Holders of the new skilled regional provisional visas will be able to apply for a Permanent Residence visa. The Permanent Residence (Skilled Regional) Visa will commence in November 2022.

Importantly, to be eligible for permanent residence, holders of the new skilled regional provisional visas will need to demonstrate they have lived and worked in regional Australia while holding one of the new Skilled Regional Provisional visa.

Benefits:

Regional employers will have access to additional regional occupations to sponsor migrants and priority processing of regional visa applications. There will also be additional points for certain points-tested migrants who are sponsored to settle in regional Australia.

Employers in regional Australia, as well as State and Territory governments, who sponsor regional skilled migrants will have access to more occupations than equivalent non-regional visas.

Based on current occupation lists, the Skilled Employer Sponsored Regional (Provisional) visa will have access to over 450 more occupations than closest non-regional equivalent visa, and the Skilled Work Regional (Provisional) visa will have access to over 70 more occupations than the closest non-regional equivalent visa.

Priority processing arrangements will be expanded to include all visa applications sponsored by regional employers as well as other visa applicants who will live and work in regional Australia.

Five additional points for regional nomination or sponsorship provide an extra incentive for potential migrants to consider settling in regional Australia.

Extra options for international graduates from regional institutions

This initiative provides for an additional Temporary Graduate visa with an extra year of post-study work rights for international students who:

- graduate from the regional campus of a registered university or institution with a higher education or postgraduate qualification; and

- maintain ongoing residence in a regional area while holding their first Temporary Graduate (subclass 485) visa

The second Temporary Graduate visa will require ongoing residence in a regional area.

The definition of regional Australia for this purpose will be the same as the definition for skilled migration – all of Australia except Sydney, Melbourne, Perth, Brisbane and the Gold Coast.

As students need to graduate from a regional campus and then spend at least two years residing in a regional area to qualify, the additional Temporary Graduate visa will be available to the first eligible cohort of graduates from 2021.

Existing Temporary Graduate visa holders may be eligible, provided they can meet these requirements.

There is no change to Student visa arrangements. This initiative simply provides an additional incentive for international students to study and live in regional Australia.

Changes to existing visas

The introduction of the two new regional visas in November 2019 will not impact people who already hold existing visas. Applications lodged prior to November 2019 will continue to be processed as normal. There will be no impact on the permanent residence of current permanent visa holders.

Temporary Sponsored Parent Visa features

- Limited to 15,000 visas per year
- Maximum 10 years cumulative stay permitted
- Parent not required to depart during validity of the visa
- Multiple entries permitted
- May be eligible for a second TSPV, however, sponsor must also re-apply to be family sponsor
- Must leave Australia for 90 consecutive days before making the second TSPV application, although sponsor can request the applicant be permitted to lodge onshore in specific circumstances
- Condition 8103 - 'no work' will be applied to the visa

Application charges:

- Sponsorship - $420
- Three year validity visa - $5000, with first instalment $1,000 and second instalment prior to visa grant of $4,000
- Five year validity - $10,000, with first instalment $1,000 and second instalment prior to visa grant of $9,000

Family sponsorship framework

The parent sponsor must be:

- at least 18 years old
- be the biological, adoptive, or step child of the parent, may also include the parent of a deceased spouse or defacto parent
- be an Australian citizens, PR or eligible NZ citizen and not be an ineligible sponsor
- only sponsor two parents at any one time
- have a minimum household taxable income threshold of $83,454.80
- have no debts to the Commonwealth or outstanding public health debts
- the family sponsor must be approved before the visa application can be lodged under the to be inserted s140AA.

Sponsorship obligations of the parent sponsor

Obligations remain in effect for the life of the visa and beyond in some cases, and include:

- liability for any outstanding public health debts incurred by the parent before they depart Australia or are granted a permanent visa.to support sponsored parents financially and provide accommodation
- to keep and provide records when requested
- to notify the Department when certain events occur eg if the sponsor is charge with or convicted of an offence, becomes the subject of an AVO or incurs a debt to the Commonwealth
- prior to sponsorship approval, agree to disclose the sponsor's criminal or family violence history or conviction to the sponsored parent.
- agree to sharing of information with other Commonwealth and State and Territory agencies

Other features and requirements

- sponsored parent must also have genuine access to funds sufficient to meet the costs and expenses of their intended stay in Australia (NB amount not yet specified)
- no balance of family test will be applied
- no sponsorship bond will be required
- sponsored parents will be required to maintain adequate health insurance for the duration of their stay in Australia
- sponsors will be required to pay in full any outstanding public health debts incurred by their parent
- the sponsored parent will also be required to disclose any criminal history particularly offences related to family violence
- sponsorship or visa refusal will be reviewable - Part 5- reviewable decisions under s338 of the Migration Act

Not a pathway to permanent residence

To prevent this visa being used as a pathway to permanent residency, Subclass 870 visa holders or previous holders who have not departed Australia, are prevented from applying for the following visas:

- Parent - Class AX
- Aged Parent - Class BP
- Contributory Parent - Class CA
- Contributory Aged Parent - Class DG
- Contributory Parent (Temporary) - Class UT

This Instrument will commence on 17 April 2019.

Migration Program ceiling for 2019-20

The Migration Program planning ceiling for 2019-20 is 160,000, with a continued focus on skills. More than two thirds of the Program is allocated to the Skilled stream, with a focus on categories that allow employers or states or territories to nominate skilled migrants. New skilled regional provisional visas

There will be two new skilled regional provisional visas introduced in November 2019:

• Skilled Employer Sponsored Regional (Provisional) visa: for people sponsored by an employer in regional Australia.
• Skilled Work Regional (Provisional) visa: for people who are nominated by a State or Territory government or sponsored by an eligible family member to live and work in regional Australia.

Under these new visas, migrants will be required to live and work in a regional area of Australia for at least three years before they are eligible to apply for permanent residence.

These new regional visas will provide greater incentives for regional employers to nominate skilled workers, including priority processing of applications and access to additional skilled occupations. Based on current eligible skilled occupation lists:

• the Skilled Employer Sponsored Regional (Provisional) visa will have almost 700 eligible occupations; and
• the Skilled Work Regional (Provisional) visa will have over 500 eligible occupations.

Holders of the new skilled regional provisional visas will need to live and work in regional Australia. Visas will be granted with a validity period of up to five years.
The introduction of the two new regional visas will not impact people who already hold existing permanent skilled visas. Applications lodged prior to November 2019 will continue to be processed as normal. Further information is available here.

New permanent visa pathway

A new permanent visa pathway, the Permanent Residence (Skilled Regional) Visa, will also be available for holders of the new regional provisional visas in November 2022. This new permanent visa will provide further incentives for migrants to bring their skills to regional Australia and grow the Australian economy.

Definition of Regional Australia

In November 2019, the definition of Regional Australia for all skilled visas will be simplified and expanded to include all of Australia except for the following metropolitan areas:

• Sydney
• Melbourne
• Brisbane
• Gold Coast
• Perth

Areas within the new regional definition will have access to the two new skilled regional provisional visas, which enable migrants and employers to access a wider range of occupations as well as receiving priority processing.

Expansion of Designated Area Migration Agreements
(DAMAs)

The expansion of Designated Area Migration
Agreements (DAMAs) will get the right skills into the
right regions, to support regional businesses and
make sure local communities thrive.

These tailored agreements are a formal agreement
between the Australian Government and a specific
regional area. They enable participating regions to
respond to their unique workforce shortages by
accessing experienced overseas workers for vacant
skilled or semi-skilled occupations that cannot be
filled by Australian workers from the local labour
market.

The Northern Territory DAMA has been operating
successfully since 2015 and a further five-year
agreement commenced in December 2018. The
Minister has also agreed to establish DAMAs in
additional regional locations:

• Kalgoorlie-Boulder, Western Australia
(Goldfields)
• Regional South Australia
• Adelaide City
• Great South Coast, Victoria (which was
announced late last year)
