Victoria’s new Security of Payment laws have changed the role of payment schedules in construction disputes.

Payment schedules are no longer just a preliminary response. Under the new regime, they may define the issues in any later adjudication, with respondents required to include all reasons for withholding payment from the outset.

With adjudication now covering a broader range of claims, including variations, delay costs, latent conditions and performance security disputes, careful contract administration is more important than ever.

About last week!

On Thursday, we held our first in-person workshop of 2026 in Sydney, where Michael Batch, Tyler Atkins and Kate Ahnfeldt guided attendees through the NSW Security of Payment Act process from start to finish.

The key theme of the workshop was the practical issues that commonly arise in adjudication - including missed deadlines, non-compliant payment schedules and failing to put forward the right material at the right time - and the significant impact these process issues can have on a party’s position once a matter progresses to adjudication.

In the first session, Kate explored how to prepare and serve valid payment claims and respond with compliant payment schedules while avoiding common pitfalls. Tyler led the second session on adjudication strategy, timing, evidentiary considerations and enforcement options following a determination.

Thank you to everyone who joined us and contributed to the insightful discussions throughout the morning.

We look forward to delivering more in-person workshops throughout the year.
