If you cannot make your own health decisions, who can decide for you?

In Queensland, a statutory health attorney may step in when you cannot make these decisions and have not appointed an attorney for health matters under an Enduring Power of Attorney.

The role may fall to the first readily available and culturally appropriate person, such as a close spouse, unpaid adult carer, or close adult friend or relation. Otherwise, the Public Guardian may take the role.

A statutory health attorney can make certain healthcare decisions, but cannot make financial decisions or consent to special healthcare matters requiring QCAT approval. They must act in your best interests, consider your wishes and protect your privacy.
