Case Update:

When we first took on this client five years ago, we knew it would be a challenging journey. She had endured years of bullying in the workplace, and her claim for psychiatric injury had been rejected by WorkCover.

After two years of persistent communication with both the Regulator and WorkCover, we were successful in having the decision overturned by the Regulator.

Once the common law process began, WorkCover’s solicitors argued that our client’s claim was partially statute-barred. Following a year of detailed discussions and evidence exchange, we ultimately persuaded them that there was no issue with the limitation period.

The matter proceeded to litigation after no settlement was reached at the compulsory conference. At that stage, WorkCover’s offer stood at $130,000. However, through our thorough investigations and the compelling medical evidence we obtained, we ultimately achieved a settlement of more than $960,000 for our client.

This is absolutely the best Christmas Gift I have ever received. It is a true testament to what sets CZ Injury Law apart from other law firms.

In 2020, I received a workplace injury enquiry where the injured worker fell some 6 metres from a man cage of a crane. He suffered horrific injuries to his head, spine and psychiatric injuries.

At the time, I had provided my preliminary views on jurisdictional issues. He also approached 4 other law firms and surprisingly, they gave him advice that was the opposite to what I had provided. Given that I was alone in my views, the injured worker decided to engage one of the larger national law firms with the belief that their advice was correct.

Yesterday afternoon, I received a phone call from the injured worker. He immediately told me how relieved he was to finally track me down. We had a brief discussion about his case and he asked for some advice about his options. Last night, I received his heartfelt email. Below are extracts of the email that he sent me.

"Hi Rosana,

My name is ###xx ###x. I spoke to you in 2020.

That's how I found you 4 years later. You stood out as the only person besides my medical treaters that made sense as in a spade is a spade. I went though my emails and googled your name. I am scared, I have been lied to so many times that I have lost track.

I am just heart broken by the way I was managed at the beginning when it came to being told by my lawyer that I had no choice. This is the main reason I engaged them. Once again, he is a good lawyer but I deeply regret I did not proceed with you. I can't change the past but my past can continue to affect my future.

You may not realise, but in hindsight, in my experience, you are an Erin Brockovich compared to all the other lawyers I had ever spoken to. If you don't mind (because I care and sympathise with anyone who has to go through what I had to go through), I will tell my psychiatrist, psychologist and all my other medical treaters to send any of their future patients based on the Gold Coast or Brisbane with work injury claims straight to you and/or your firm.

My lawyer always shuts me down when I want to know about things such as cap exemptions. My lawyer never addressed the jurisdictional issues as clear as the way you did with me.

My lawyer has told me that my settlement meeting is next week and if you can let me know if you would be able to intervene or not, that would be wonderful. I value the fact that you call a spade a spade more than you could imagine. RESPECT!!! I have otherwise been told endless lies that is so ridiculous I don't even know how they can live with themselves.

I have lost everything and have had to use my super to survive this long. It's just heart breaking. Sorry, anyway, thank you so much and I will continue to push through. When I speak to you, I feel like a person. When I speak with other lawyers, I feel like they are the teacher and I am a naive child. I will leave it at that. Thank you so much for your time.

This experience has given me a very grim outlook on people and a disbelief that humans are worthy of trust. But you are a shining light and that is something. It may be very rare these days but you remind me it does exist.

Case Study: Our client suffered injuries to his right hand as a result of a motor bike accident. The collision caused our client to flip over his handle bars and landed metres away from the collision site.

There were no witnesses nor dashcam footage and liability was in dispute. After going back and forth with the CTP insurer about the circumstantial evidence, we managed to convince them that their insured was at fault.

Our client was assessed with 27%, 36% and 48% whole person impairment by medical specialists from various disciplines.

Our client’s instructions were to attempt settlement for half a million dollars. We resolved our client’s claim over and beyond his expectations. Another happy client ☺️

Eduardo was admitted as a solicitor in 2004 and have since worked exclusively with a culturally diverse client base, particularly in personal injuries compensation.

Eduardo has been a committee member of the Queensland Law Society’s Tort Law since 2017. He is actively engaged in procedural and legislative reform across motor vehicle accident insurance, workers’ compensation, public liability insurance and sexual abuse claims.

Prior to joining CZ Injury Law, Eduardo was the Principal of a personal injury team in a Brisbane based law firm. He also worked at WorkCover Queensland, heading a team of experienced lawyers in defending workplace accident claims.

Eduardo’s extensive 20 years’ experience, both in the defendant and plaintiff personal injuries has moulded him into a versatile and resourceful professional.

Abigail started her legal career in 2002 in conveyancing. She later took on the opportunity to work in the personal injury space, initially as a legal secretary and later, a paralegal.
