Case Update:
When we first took on this client five years ago, we knew it would be a challenging journey. She had endured years of bullying in the workplace, and her claim for psychiatric injury had been rejected by WorkCover.
After two years of persistent communication with both the Regulator and WorkCover, we were successful in having the decision overturned by the Regulator.
Once the common law process began, WorkCover’s solicitors argued that our client’s claim was partially statute-barred. Following a year of detailed discussions and evidence exchange, we ultimately persuaded them that there was no issue with the limitation period.
The matter proceeded to litigation after no settlement was reached at the compulsory conference. At that stage, WorkCover’s offer stood at $130,000. However, through our thorough investigations and the compelling medical evidence we obtained, we ultimately achieved a settlement of more than $960,000 for our client.
