As a qualified Mediator who has an extensive background in the venture capital industry as well negotiating, small business, workplace and staff, I am passionate about MEDIATION as a potential alternative for many issues to the legal and court pathway. Let me tell you why:

Mediation is a non-adversarial facilitative method that helps people settle disputes as an option to avoid escalating an issue to the courts. Mediation is for any people, groups, partners, organisations or businesses that wish to instigate a meeting to solve issues. There are cooperative ways of negotiating differences on a range of issues for almost any conflict or dispute. Taking part in facilitative mediation can save time, legal fees and court costs for you and the community.

Alternative dispute mediation is where an unbiased mediator facilitates a process that allows two parties to decide the issues between themselves. This is done by identifying the issues, exploring options, considering alternatives and transforming them into problem-solving opportunities. The parties may reach an agreement about some issues or the whole dispute.

My favourite part - research confirms that in about 79 percent of mediations, the parties will reach an agreement that they can both live with, that is better than the alternative.

It is worth noting also that mediation often becomes a compulsory part of the judicial process where the courts are now regularly directing that mediation is undertaken before setting a court date. However, any party can instigate a mediation without a court directive or other potentially costly legal involvement.

* Mediation has proven to be the cost-effective alternative to surrendering to an adjudicator the right to determine the outcome of the dispute at hand.
* Timely process with little waiting time.

Avoids destructive escalation

* The mediation process can avoid destructive escalation and lost opportunities to find solutions that are better for both sides, which they agree is better than the alternative.

WORKPLACE CONFLICT RESOLUTION

MEDIATION is often used for workplace conflict resolution, is increasingly popular as being able to de-escalate workplace situations and manage change with minimal fuss and saves employers significant money.

It has become increasingly popular since the mid-1990s when governments and businesses realised the benefits of settling disputes outside of the courts.

“The rising cost of litigation and the rising incidence of industrial action have contributed to the growing use of industry services,” the report reveals. “Industry profitability has grown steadily over the period and the number of enterprises and establishments operating in the industry has followed suit.” Industry revenue was forecast to grow by 5.7 percent in 2014-15 to reach $1.5 billion.

Australian Mediation Association chief executive Callum Campbell says the most common applications for mediation in the workplace are bullying and harassment, return-to-work issues and procedures, differing working and leadership styles, allegations of discrimination, and role clarification.

“If there is group conflict, we can enhance the way they communicate with each other,” he says. “You can use it all the way up to board level.”
